HOUSE BILL NO. 568

MTR VEHICLE/DRIVER LIC:  Requires a commercial motor vehicle driver's license to
transport certain commodities in commercial motor vehicles
1	AN ACT
2To amend and reenact R.S. 32:408(A)(8)(b)(introductory paragraph), relative to the
3 operation of a motor vehicle without the necessity of a commercial driver's license;
4 to require a commercial driver's license for the operation of a truck hauling sugar
5 cane; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 32:408(A)(8)(b)(introductory paragraph) is hereby amended and
8reenacted to read as follows:
9 ยง408.  Examination of applicants required; classes of licenses

12	(8)  The department may permit drivers possessing a valid Class "D" or "E"
13 license issued pursuant to this Chapter to operate the following vehicles without a
14 commercial driver's license, subject to the following limitations:

16	(b)  A farm vehicle which is controlled and operated by a farmer, including
17 operation by employees or family members, is used to transport agricultural
18 products, except sugar cane, farm machinery, or farm supplies, to or from a farm, is
19 not used in the operations of a common or contract motor carrier, and is used within
20 one hundred fifty miles of the farmer's farm.  Farm vehicles used to haul sugar cane

1 on public roadways shall only be operated by a person in possession of a commercial
2 driver's license.  In order to qualify for this the exemption provided by this
3 Subparagraph, an applicant shall meet the following criteria:

Abstract: Requires a commercial driver's license to haul sugar cane on public roadways.
Present law authorizes the Dept. of Public Safety and Corrections to permit licensed drivers
without a commercial driver's license to operate farm vehicles not used in the operations of
a common or contract motor carrier within 150 miles of the farmer's farm.
Proposed law requires that operators of farm vehicles hauling sugar cane on the public
roadways possess a commercial driver's license.
