ENROLLED ACT No. 660 2016 Regular Session HOUSE BILL NO. 572 BY REPRESENTATIVES SMITH, ADAMS, AND STEVE CARTER 1 AN ACT 2 To amend and reenact R.S. 47:463.31(B), (C), (E), (F), (G)(1), and (H) and to enact R.S. 3 47:463.31(J), relative to the issuance of special college and university license plates; 4 to increase the fee for such plates; to provide relative to charitable donations 5 associated with such plates; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 47:463.31(B), (C), (E), (F), (G)(1), and (H) are hereby amended and 8 reenacted and R.S. 47:463.31(J) is hereby enacted to read as follows: 9 ยง463.31. Special college and university license plates 10 * * * 11 B.(1) The prestige license plates shall be issued, upon application, to any 12 citizen of Louisiana in the same manner as any other motor vehicle license plate. 13 The applicant shall designate his institutional preference. 14 (2) Application for college or university special prestige license plate 15 constitutes prior written consent and instruction by the applicant to the department 16 to provide his name, address, and birth date to the university designated by the 17 applicant. The secretary shall ensure that the application for the plate includes a 18 statement granting such consent. 19 C. An annual royalty fee of twenty-six dollars for the use of the institution's 20 design by the department fifty-one dollars shall be paid to the institution for each 21 license plate issued as provided in this Section. 22 * * * Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 572 ENROLLED 1 E. The department shall collect the annual royalty fee required by Subsection 2 C of this Section for each license plate. The department shall retain one dollar from 3 each annual royalty fee to offset administrative costs. The remainder of the royalty 4 fee shall be forwarded to the specific institution for which such license plate is 5 designated. The amount forwarded to the designated institution shall be deemed to 6 be a charitable donation to that institution by the applicant. 7 F. The secretary shall establish such rules and regulations as are necessary 8 to implement the provisions of this Section, including but not limited to rules and 9 regulations governing the collection and disbursement of royalty fees, the transfer 10 and disposition of such license plates, the colors available, and the design criteria. 11 G.(1) The monies received from the royalty fees by each respective 12 institution shall be used solely for academic or financial need-based scholarships for 13 that participating institution. 14 * * * 15 H. Upon the signing of a contract authorizing the use of the logo of any 16 regionally accredited independent college or university, the secretary of the 17 Department of Public Safety and Corrections shall establish prestige motor vehicle 18 license plates for said that college or university in accordance with the provisions of 19 this Section. This contract shall include an agreement on the part of each institution 20 to use the royalty fees as provided in Subsection G of this Section. 21 * * * 22 J. In the event the motor vehicle registration system of the office of motor 23 vehicles is re-engineered, or other technology is otherwise made available to the 24 office of motor vehicles, that would allow for the issuance of personalized special 25 college and university license plates by the office of motor vehicles, then upon the 26 promulgation of rules by the department providing for issuance of a personalized 27 prestige plate under the provisions of this Section, an applicant may request such 28 plate at no additional cost to the applicant above the annual fee as provided in this Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions.
