HOUSE BILL NO. 601
BY REPRESENTATIVE JACKSON
AGRICULTURE:  Provides relative to the susceptibility of the Department of Agriculture
and Forestry being declared an indispensable party in certain lawsuits
1	AN ACT
2To enact R.S. 3:11, relative to suits against the Department of Agriculture and Forestry; to
3 provide for the department's susceptibility to suits under certain conditions; and to
4 provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 3:11 is hereby enacted to read as follows: 
7 ยง11.  Suits against the department
8	A.  The department shall not be an indispensable party in any suit filed
9 against a board or commission or its members pursuant to this Title if the majority
10 of the board's appointments are not made by the commissioner.

Abstract:  Prohibits the Department of Agriculture and Forestry from being declared an
indispensable party for suits filed against the department in certain circumstances.
Proposed law prohibits the department from being an indispensable party in any suit filed
against a board or commission or its members if the majority of the board's appointments
are not made by the commissioner.
