MOTOR VEHICLES: Requires nonrenewal of driving school contracts to be based upon
same factors for termination of driving school contracts
1 AN ACT
2To amend and reenact R.S. 40:1461(C), relative to driver training; to require nonrenewal
3 of driving school licenses and contracts; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1. R.S. 40:1461(C) is hereby amended and reenacted to read as follows:
6 ยง1461. Requirements for private training and driving instructor schools

8 C.(1) The deputy secretary of the Department of Public Safety and
9 Corrections, public safety services, shall establish rules and regulations governing
10 the issuance, renewal, and revocation of requirements and qualifications of each
11 applicant and enumerating the terms of the contract and causes of suspension,
12 nonrenewal, or revocation of the contract and possible fines for violations committed
13 thereunder in accordance with the Administrative Procedure Act and subject to
14 oversight review by the House and Senate committees on transportation, highways
15 and public works.
16 (2) The Department of Public Safety and Corrections, public safety services,
17 shall not renew the licenses or contracts for private driver instructor training schools
18 or agencies, or any person providing driving courses, and offering instruction as a

1 driving school instructor if the department finds that the party seeking renewal has
2 engaged prohibited activity as defined in R.S. 40:1463.

Abstract: Provides requirements for the nonrenewal of licenses or contracts for private
driver instructor training schools or agencies, or any person providing driving
courses, and offering instruction as a driving school instructor if the party seeking
renewal has engaged in prohibited activity.
Proposed law provides that the Dept. of Public Safety and Corrections, public safety
services, shall not renew the license or contracts for private driver instructor training schools
or agencies, or any person providing driving courses, and offering instruction as a driving
school instructor if the department finds that the party seeking the renewal has engaged in
prohibited activity as defined in present law.
