LEVEES: Provides relative to the Southeast Flood Protection Authority East and West
Bank
1 AN ACT
2To amend and reenact R.S. 38:330.1(C)(2)(a)(introductory paragraph) and (D)(2) and to
3 enact R.S. 38:330.2(A)(2)(c), relative to regional flood protection authorities; to
4 provide for the powers and duties of the boards of commissioners of flood protection
5 authorities; to provide for nominating committees and the boards of commissioners
6 for the Southeast Louisiana Flood Protection Authority-East and the Southeast
7 Louisiana Flood Protection Authority-West Bank; to provide for terms; and to
8 provide for related matters.
9 Notice of intention to introduce this Act has been published
10 as provided by Article III, Section 13 of the Constitution of
11 Louisiana.
12Be it enacted by the Legislature of Louisiana:
13 Section 1. R.S. 38:330.1(C)(2)(a)(introductory paragraph) and (D)(2) are hereby
14amended and reenacted and R.S. 38:330.2(A)(2)(a) is hereby enacted to read as follows:
15 §330.1. Southeast Louisiana Flood Protection Authority-East and Southeast
16 Louisiana Flood Protection Authority-West Bank; territorial jurisdiction;

2 (2)(a) The members of the nominating committee for each board shall serve
3 no more than two four-year terms and each nominating committee shall be composed
4 as follows:

8 (2) All commissioners thereafter appointed, except a commissioner
9 appointed to fill an unexpired term, shall be appointed as provided in Subsection C
10 of this Section for staggered terms of four years. No member shall serve more than
11 two consecutive four-year terms.

18 (c) After January 1, 2018, neither the authority nor any levee district within
19 the territorial jurisdiction of the authority shall function as a drainage district.

Abstract: Provides relative to the terms of nominating committees and boards of
commissioners for the Southeast Louisiana Flood Protection Authority-East and
West Bank.
Present law provides relative to the composition of the nominating committee for each
board.

Proposed law limits the term to no more than two four-year terms for members of the
nominating committee that nominates members to the board of commissioners of the
regional flood protection authorities.
Present law limits the terms of commissioners of a board governing a regional flood
protection authority to no more than two consecutive four-year terms. Proposed law limits
such commissioners to only two four-year terms for life.
Proposed law prohibits the authority or any levee district within territorial jurisdiction of the
authority from functioning as a drainage district after Jan. 1, 2018.
(Amends R.S. 38:330.1(C)(2)(a)(intro. para.) and (D)(2); Adds R.S. 38:330.2(A)(2)(c))
