HOUSE BILL NO. 698
BY REPRESENTATIVE STOKES
PORTS/HARBORS/TERMINALS:  Changes territorial jurisdiction of the Port of New
Orleans and the Port of South Louisiana
1	AN ACT
2To amend and reenact R.S. 34:2471(A) and 2473(A) and to enact R.S. 34:21(A)(3), relative
3 to the territorial limits of the Port of New Orleans and the Port of South Louisiana;
4 to revise the territorial jurisdiction of the Port of New Orleans; to revise the
5 territorial jurisdiction of the Port of South Louisiana; and to provide for related
6 matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 34:2471(A) and 2473(A) are hereby amended and reenacted and R.S.
934:21(A)(3) is hereby enacted to read as follows:
10 §21.  Rights and powers of board in general
11	A.(1)  The board of commissioners shall regulate the commerce and traffic
12 of the port and harbor of New Orleans in such manner as may, in its judgment, be
13 best for the maintenance and development thereof.

15	(3)  However, regulation of such commerce and traffic including international
16 commerce within Jefferson Parish shall be governed by the provisions of R.S.
17 34:2471 et seq.

1 §2471.  Creation; membership
2	A.  There is hereby created the Port of South Louisiana, as a political
3 subdivision of the state, with jurisdictional authority encompassing the geographical
4 boundaries of the parishes of Jefferson, St. Charles, St. John the Baptist, and St.
5 James.  The Port of South Louisiana shall be governed by a board of commissioners
6 to be known as the "Port of South Louisiana Commission", which shall be composed
7 of seven members who shall be appointed as follows:

9 §2473.  Jurisdictional boundaries; rights and powers of commission and executive
10	director
11	A.  The commission shall exercise the powers herein conferred upon it within
12 the port area consisting of the parishes of Jefferson, St. Charles, St. John the Baptist,
13 and St. James, as the boundaries and limits are presently fixed by law.

Abstract:  Places Jefferson Parish within both the Port of New Orleans and the Port of
South Louisiana.
Present law creates the Port of New Orleans and includes Jefferson Parish within the port
geographical jurisdiction.  Present law also creates the Port of South Louisiana consisting
of St. Charles Parish, St. John the Baptist Parish, and St. James Parish.
Proposed law keeps Jefferson Parish within the Port of New Orleans but also adds it to the
Port of South Louisiana and provides that regulation of commerce and traffic including
international commerce within Jefferson Parish shall be governed by the Port of South
Louisiana.
