HOUSE BILL NO. 715

ALCOHOLIC BEVERAGES:  Exempts certain products from the size limitations on
containers of beverages of high alcoholic content
1	AN ACT
2To amend and reenact R.S. 26:351(9), relative to the size of containers for beverages of high
3 alcoholic content; to provide relative to the exemption of certain products; and to
4 provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 26:351(9) is hereby amended and reenacted to read as follows: 
7 ยง351.  Limitation on size of containers of beverages of high alcoholic content;
8	standards of fill
9	Except for wines, no manufacturer or wholesaler in this state shall have in his
10 possession any beverages of high alcoholic content outside of his bonded stockroom
11 unless they are in containers of no greater capacity than 1.75 liters.  The standards
12 of fill shall be the following:

14	(9)  The container and case restrictions provided for in this Section shall not
15 apply to cider products, or any other wine products containing less than seven
16 percent alcohol by volume, provided that such restrictions otherwise comply with
17 applicable federal law.

Abstract:  Exempts wine products containing less than 7% alcohol from certain limitations
on size of containers of beverages of high alcoholic content shipped and sold in
Louisiana.
Present law provides for limitations on size of containers of beverages of high alcoholic
content, and exempts cider products from container size restrictions.
Proposed law retains present law and adds that container and case restrictions shall not apply
to cider products, or any other wine products containing less than 7% alcohol by volume,
provided that the container and case restrictions comply with applicable federal law.
