HOUSE BILL NO. 75

TEACHERS:  Requires teachers in all public and nonpublic schools participating in the
voucher program to take the state assessments aligned with the state content
standards
1	AN ACT
2To enact R.S. 17:24.4(F)(5), 3996(B)(42), and 4022(7), relative to education standards and
3 related assessments; to require public school teachers and certain teachers in
4 nonpublic schools to take certain required state assessments; to require such
5 nonpublic schools to comply with the assessment requirements; to provide for
6 policies of city, parish, and other local public school boards; and to provide for
7 related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 17:24.4(F)(5), 3996(B)(42), and 4022(7) are hereby enacted to read
10as follows:
11 §24.4.  Louisiana Competency-Based Education Program; statewide standards for
12	required subjects; Louisiana Educational Assessment Program; parish or city
13	school board comprehensive pupil progression plans; waivers

17	(5)(a)  All public school teachers and teachers of scholarship recipients
18 enrolled in nonpublic schools participating in the Student Scholarships for
19 Educational Excellence Program pursuant to R.S. 17:4011, et seq. shall take the state

1 assessments required pursuant to this Section or to any rule, regulation, or policy of
2 the State Board of Elementary and Secondary Education that is aligned to the state
3 content standards prior to administering such assessments to students.
4	(b)  Each city, parish, and other local public school board shall adopt a policy
5 to provide for implementation of the requirements of this Paragraph.  The policy
6 shall require that after taking such assessments, each teacher shall submit his
7 observations and comments on the assessments to the local superintendent who shall
8 be responsible for submitting the compiled observations and comments to the House
9 Committee on Education and the Senate Committee on Education.  The compiled
10 observations and comments shall not include any teacher's name but shall include the
11 grade levels and subjects taught by each teacher.
12	(c)  Teachers of scholarship recipients enrolled in participating nonpublic
13 schools and teachers in charter schools shall submit their observations and comments
14 to the local superintendent of the public school system in which parish the nonpublic
15 school or charter school is located.

17 §3996.  Charter schools; exemptions; requirements

19	B.  Notwithstanding any state law, rule, or regulation to the contrary and
20 except as may be otherwise specifically provided for in an approved charter, a
21 charter school established and operated in accordance with the provisions of this
22 Chapter and its approved charter and the school's officers and employees shall be
23 exempt from all statutory mandates or other statutory requirements that are
24 applicable to public schools and to public school officers and employees except for
25 the following laws otherwise applicable to public schools with the same grades:

1 §4022.  Participating schools; requirements
2	Each participating school shall:

5 requirements for teachers to take state assessments.

Abstract:  Requires all public school teachers (including charter schools) and teachers of
scholarship (voucher) recipients in nonpublic schools participating in the voucher
program to take the state assessments aligned to the state content standards prior to
administering such assessments to students.
Present law provides for the La. Competency-Based Education Program, including the
development and implementation of statewide content standards for required subjects and
the La. Educational Assessment Program (LEAP) by the state Dept. of Education with
approval of the State Board of Elementary and Secondary Education (BESE).  Requires
standards-based assessments for required subjects (English language arts, math, science, and
social studies) to be implemented by BESE and administered in at least grades three through
11.  Provides that such assessments be based on state content standards and rigorous student
achievement standards comparable to national student achievement levels.  Specifies that
beginning with the 2014-2015 school year, the standards-based assessments in English
language arts and math shall be based on nationally recognized content standards.
Proposed law retains present law and adds a requirement that all public school teachers
(including charter schools) and teachers of scholarship (voucher) recipients in nonpublic
schools participating in the voucher program take the state assessments required pursuant
to present law or BESE rule, regulation, or policy aligned to the state content standards prior
to administering such assessments to students.  Further requires that after taking such
assessments, each teacher shall submit his observations and comments on the assessments
to the local superintendent who shall submit the compiled observations and comments to the
House and Senate education committees.  Requires local public school boards to adopt
policies to provide for implementation of proposed law.
Present law relative to the Student Scholarships for Educational Excellence Program,
requires nonpublic schools participating in the program to comply with specified criteria.
Proposed law adds that such schools shall comply with the requirements of proposed law
relative to teachers taking the state assessments prior to administering such assessments to
students and submitting observations and comments relative thereto.
