HLS 16RS-438 ORIGINAL 2016 Regular Session HOUSE BILL NO. 758 BY REPRESENTATIVE PUGH MTR VEHICLE/INSPECTION: Provides relative to school bus inspection fees 1 AN ACT 2To enact R.S. 32:1306(C)(6), relative to school bus inspection fees, to provide for a school 3 bus inspection fee equivalent to that of commercial motor vehicles; to provide for a 4 two-year increase to bring school bus inspection fees to the level of commercial 5 motor vehicle inspection fees; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 32:1306(C)(6) is hereby enacted to read as follows: 8 ยง1306. Operation of official inspection stations 9 * * * 10 C.(1)(a) A charge or fee shall be charged for each certificate of inspection 11 and approval issued, as provided in this Subsection. 12 * * * 13 (6)(a) On January 1, 2017, the charge or fee for the inspection of student 14 transportation vehicles which are required to be inspected under LAC 15 28:CXII.701(A)(3) shall be twenty dollars. No charges or fees other than the twenty- 16 dollar fee shall be charged for a student transportation vehicle inspection beginning 17 on January 1, 2017. Of the twenty-dollar fee, the motor vehicle inspection station 18 operator who performs this inspection shall retain fourteen dollars and twenty-five 19 cents; one dollar and seventy-five cents shall be transferred to the office of motor 20 vehicles for expenses associated with motor vehicle and financial responsibility Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 16RS-438 ORIGINAL HB NO. 758 1 programs; and four dollars shall be transferred to the office of state police for use in 2 law enforcement. 3 (b) On January 1, 2018, the charge or fee for the inspection of student 4 transportation vehicles which are required to be inspected under LAC 5 28:CXII.701(A)(3) shall be the charge or fee that is imposed for the inspection of 6 commercial motor vehicles as set forth in Paragraph (5) of this Subsection. The 7 distribution of the charge and fee shall also be the same as that set forth in Paragraph 8 (5) of this Subsection. No charges or fees other than the charge or fee set forth in 9 Paragraph (5) of this Subsection shall be charged for a student transportation vehicle 10 inspection beginning on January 1, 2018. 11 (c) The adjustment of headlights shall be included in the inspection at no 12 additional cost to the owner or operator of the school bus being inspected. 13 (d) The Legislature of Louisiana hereby declares that a student transportation 14 vehicle inspection is much more extensive than the inspection required in Paragraph 15 (2) of this Subsection and that the increase in the fee or charge for the inspection of 16 student transportation vehicles is based on the difference in the two types of 17 inspections. 18 * * * DIGEST The digest printed below was prepared by House Legislative Services. Requires a $20 inspection fee beginning on Jan. 1, 2017. Increases the fee to the amount charged for commercial motor vehicles beginning on Jan. 1, 2018. Provides for distribution of the inspection fees collected. Proposed law provides an inspection fee of $20 for student transportation vehicles beginning Jan. 1, 2017. The $20 fee must be distributed as follows: $14.25 remains with the inspection station operator; $4 must be transferred to the office of state police; and $1.75 must be transferred to the office of motor vehicles. HLS 16RS-438 ORIGINAL HB NO. 758 Proposed law increases the inspection fee for student transportation vehicles to the present law amount ($30) that is required for commercial motor vehicles, of which $23.75 remains with the inspection station operator; $2.25 must be transferred to the office of motor vehicles; and $4 must be transferred to the office of state police. Requires the inspection fee to be distributed as required in present law for commercial motor vehicles.
