HLS 16RS-1148 ORIGINAL 2016 Regular Session HOUSE BILL NO. 762 BY REPRESENTATIVE JACKSON MENTAL HEALTH: Provides relative to referrals of certain Medicaid enrollees for mental health counseling or treatment by managed care providers 1 AN ACT 2To enact Subpart D of Part XIII of Chapter 3 of Title 50 of the Louisiana Revised Statutes 3 of 1950, to be comprised of R.S. 46:460.81, relative to the Medicaid managed care 4 program; to require referrals of Medicaid enrollees for mental health counseling or 5 treatment by managed care providers in certain cases; and to provide for related 6 matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. Subpart D of Part XIII of Chapter 3 of Title 50 of the Louisiana Revised 9Statutes of 1950, comprised of R.S. 46:460.81, is hereby enacted to read as follows: 10 SUBPART D. MENTAL HEALTH SERVICES 11 ยง460.81. Mental health services; referrals required in certain cases 12 A. The requirements of this Section shall apply when a provider delivers 13 health care services through a managed care organization to an enrollee whom he 14 knows to be pregnant. 15 B. In any case described by Subsection A of this Section, if the pregnant 16 woman requests mental health counseling or treatment, the provider shall refer the 17 woman for such counseling or treatment as soon as practicable, and without any 18 unnecessary delay. Proposed law provides that its requirements apply in cases when a provider delivers health care services through a Medicaid managed care organization to a Medicaid enrollee whom he knows to be pregnant. Proposed law provides that in any such case, if the pregnant woman requests mental health counseling or treatment, the provider shall refer the woman for those services as soon as practicable, and without any unnecessary delay.
