HOUSE BILL NO. 838

MOTOR VEHICLES:  Provides relative to background checks for employees of third party
testers or agents for the office of motor vehicles
1	AN ACT
2To amend and reenact R.S. 32:408.1(6), relative to background checks required for persons
3 who perform certain services relating to motor vehicles; to provide for limitations
4 on background checks required of certain persons who have or are seeking a contract
5 or license with the Department of Public Safety and Corrections, public safety
6 services, to perform certain services relative to motor vehicles; and to provide for
7 related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 32:408.1(6) is hereby amended and reenacted to read as follows:
10 ยง408.1.  Third-party testing; proof of testing
11	The Department of Public Safety and Corrections, public safety services, may
12 contract with or license another state, an employer, a private driver training facility,
13 driver education course provider, or other private institution, or a department,
14 agency, or instrumentality of a local government to administer the skills tests as
15 specified herein if all of the following conditions are met:

17	(6)  The principal of the third-party examiner or tester who has or is seeking
18 a contract with the Department of Public Safety and Corrections, public safety
19 services, to administer commercial driving examinations and tests shall consent to,
20 pass, and pay the costs of an annual background check.  Following the initial

1 background check, the annual background check of the principal of the third-party
2 examiner or tester shall be the same as required of employees of the Department of
3 Public Safety and Corrections, office of motor vehicles, and shall not require
4 submission of fingerprints.

Abstract:  Following the initial background check, requires the annual background check
of the principal of the third-party examiner or tester be the same as what is required
of employees of the Dept. of Public Safety and Corrections, office of motor vehicles,
and prohibits the department from requiring submission of fingerprints.
Present law requires the principal of the third-party examiner or tester who has or is seeking
a contract with the Dept. of Public Safety and Corrections, public safety services, to
administer commercial driving examinations and tests must consent to, pass, and pay the
costs of an annual background check.
Proposed law requires that following the initial background check, the annual background
check of the principal of the third-party examiner or tester must be the same as what is
required of employees of the Dept. of Public Safety and Corrections, office of motor
vehicles, and
cannot require submission of fingerprints.
