HLS 16RS-1320 ORIGINAL 2016 Regular Session HOUSE BILL NO. 923 BY REPRESENTATIVE LOPINTO MOTOR VEHICLES: Provides for unauthorized acts relative to motor vehicles 1 AN ACT 2To enact R.S. 32:1261(A)(1)(z), relative to unauthorized acts regarding motor vehicles; to 3 impose restrictions; and to provide for related matters. 4Be it enacted by the Legislature of Louisiana: 5 Section 1. R.S. 32:1261(A)(1)(z) is hereby enacted to read as follows: 6 ยง1261. Unauthorized acts 7 A. It shall be a violation of this Chapter: 8 (1) For a manufacturer, a distributor, a wholesaler, distributor branch, factory 9 branch, converter or officer, agent, or other representative thereof: 10 * * * 11 (z)(i) To penalize a dealer for any rule infraction regarding Customer 12 Satisfaction Index (CSI) surveys and incentive programs, which are funded by the 13 manufacturer or distributor and paid to a dealership employee, when the infraction 14 is committed by a dealership employee for his own personal gain. 15 (ii) Any survey found to be in violation of the provisions of this Paragraph 16 shall be voided. 17 * * * Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law enumerates a list of restrictions imposed on motor vehicle manufacturers, distributors, wholesalers, distributor branches, factory branches, converters, or the officers, agents, or other representatives thereof. Proposed law retains present law and adds that it shall be a violation of present law when motor vehicle manufacturers, distributors, wholesalers, distributor branches, factory branches, converters, or the officers, agents, or other representatives thereof penalize a dealer for any rule infraction regarding Customer Satisfaction Index (CSI) surveys and incentive programs when the infraction is committed by a dealership employee for his own personal gain. Proposed law adds that any survey found to be in violation of proposed law shall be voided.
