HOUSE BILL NO. 938

CRIME:  Creates the crime of unlawful display of profane material in historic districts
1	AN ACT
2To enact R.S. 14:106.4, relative to offenses affecting general peace and order; to create the
3 crime of unlawful display of profane material in certain locations; to provide for
4 elements of the crime; to provide criminal penalties; to provide definitions; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 14:106.4 is hereby enacted to read as follows: 
8 ยง106.4.  Unlawful display of profane material in historic districts; penalties
9	A.  It shall be unlawful to display profane material in retail stores located in
10 any historic district when the profane material is visible to the public from outside
11 the retail store.
12	B.  For purposes of this Section, the term "profane material" means any
13 material including but not limited to t-shirts, other clothing, signs, displays, and any
14 other matter, which includes language that is vituperative, invective, blasphemous,
15 or offensive.
16	C.  Whoever violates the provision of this Section shall be fined not more
17 than two thousand dollars, imprisoned for not more than two years, or both.

Proposed law creates the crime of unlawful display of profane material in historic districts
and provides criminal penalties of a fine of not more than $2,000, imprisonment for not more
than two years, or both.
Proposed law defines "profane material" as any material including but not limited to t-shirts,
other clothing, signs, displays, and any other matter, which includes language that is
vituperative, invective, blasphemous, or offensive.
