HLS 16RS-26 ORIGINAL 2016 Regular Session HOUSE CONCURRENT RESOL UTION NO. 130 BY REPRESENTATIVE LANCE HARRIS CHILDREN/SUPPORT: Directs the Louisiana State Law Institute to study and make recommendations to the legislature regarding child support enforcement 1 A CONCURRENT RESOL UTION 2To authorize and direct the Louisiana State Law Institute to study the laws regarding child 3 support and enforcement in Louisiana, relative to the enforcement of support, 4 handling income assignment orders, and the administration of state trusts to address 5 large settlement amounts in Louisiana, and to submit a written report of its findings 6 and recommendations to the legislature. 7 WHEREAS, the issue of child support is of the utmost importance to the people of 8Louisiana; and 9 WHEREAS, Louisiana has many children who are owed financial support through 10a child support order; and 11 WHEREAS, the state of Louisiana has an interest in facilitating compliance with 12these orders, and Louisiana allows income assignment liens to ensure that children receive 13the support owed to them by their parents; and 14 WHEREAS, judgments may be reduced by the state for past due support, and 15attorney fees may be used to reduce child support obligations; and 16 WHEREAS, when large payments of past due child support are received at one time, 17there may be an opportunity for some parents to use those funds inappropriately. 18 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 19authorize and direct the Louisiana State Law Institute to examine the laws and procedures 20for child support, the enforcement of child support, the handling of income assignment 21orders, and the possible administration of trust funds to address large settlement amounts in 22Louisiana.
