HLS 16RS-4978 ORIGINAL 2016 Regular Session HOUSE STUDY REQUEST NO. 4 BY REPRESENTATIVE TALBOT LOCAL GOVERNMENT: Requests the House Committee on Municipal, Parochial and Cultural Affairs to study and make recommendations regarding procedures that can be implemented to address the failure of local governmental subdivisions to make timely payments on public works contracts 1 A STUDY REQUEST 2To the House Committee on Municipal, Parochial and Cultural Affairs to study and make 3 recommendations regarding procedures that can be implemented in order to address 4 the failure of local governmental subdivisions to make timely payments on public 5 works contracts and to report its findings to the House of Representatives no later 6 than thirty days prior to the convening of the 2017 Regular Session of the Legislature 7 of Louisiana. 8 WHEREAS, public works improvements such as roadways, railways, drainage 9systems, sewage and water treatment systems, airports, harbor areas, and ports are all 10necessary to make modern societies work efficiently and effectively; and 11 WHEREAS, public works improvements affect the everyday lives of citizens 12residing in local communities throughout the state of Louisiana, and citizens depend on local 13governmental subdivisions to provide many of these improvements within their respective 14communities; and 15 WHEREAS, House Bill No. 1128 of the 2016 Regular Session of the Legislature 16proposes to enact R.S. 39:2211 to establish time frames within which all obligations arising 17under public contracts are to be paid and remedies for those who fail to receive timely 18payments; and 19 WHEREAS, testimony was given during a committee hearing on House Bill No. 201128 regarding issues that arise when local governmental subdivisions fail to make timely Page 1 of 2 HLS 16RS-4978 ORIGINAL HSR NO. 4 1payments on public works contracts, including financial stress endured by those who are 2parties to such contracts and the exposure of the public to potential safety hazards; and 3 WHEREAS, local governmental subdivisions must provide public work 4improvements of the highest quality, and it is imperative that they make timely payments to 5contractors who provide such improvements in order to ensure that quality standards are 6maintained, which will ultimately ensure the health and safety of their residents. 7 THEREFORE, the House of Representatives of the Legislature of Louisiana requests 8the House Committee on Municipal, Parochial and Cultural Affairs to study and make 9recommendations regarding procedures that can be implemented in order to address the 10failure of local governmental subdivisions to make timely payments on public works 11contracts and to report its findings to the House of Representatives no later that thirty days 12prior to the convening of the 2017 Regular Session of the Legislature of Louisiana.
