SENATE BILL NO. 160
BY SENATOR CORTEZ 
PUBLIC CONTRACTS.  Authorizes DOTD to conduct RFQ and RFP bid process
concurrently and to issue a single RFQ for multiple projects. (gov sig)
1	AN ACT
2 To enact R.S. 48:250.3(I), relative to design-build contracts; to authorize the Department of
3 Transportation and Development to conduct Request for Qualifications and Request
4 for Proposal bid processes concurrently; to authorize DOTD to issue a single Request
5 for Qualifications for multiple projects; to provide for an effective date; and to
6 provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 48:250.3(I) is hereby enacted to read as follows:
9 ยง250.3. Design-build contracts; qualifications of design-build entities; public
10	announcement procedures; letters of interest; selection of short list;
11	bid proposals by competitors; qualifications evaluation committee;
12	proposal review committee; selection and process of award

14	I. The department may conduct the RFQ and the RFP processes
15 concurrently for a particular project. The department may also issue a single
16 RFQ for multiple projects.
17 Section 2. This Act shall become effective upon signature by the governor or, if not

1 signed by the governor, upon expiration of the time for bills to become law without signature
2 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
3 vetoed by the governor and subsequently approved by the legislature, this Act shall become
4 effective on the day following such approval.

Present law authorizes DOTD to engage in design-build contracts whereby the entity is
contractually responsible for delivering the project design and construction. As part of the
process in selecting the entity, the department conducts a Request for Qualifications (RFQ)
process to identify entities experienced and qualified to design and build the project and a
Request for Proposal (RFP) process to determine the winning design-build proposal of the
qualified entities.
Proposed law allows DOTD to conduct the RFQ and RFP processes concurrently for a
particular project. Proposed law also allows DOTD to issue a single RFQ for multiple
projects.
Effective upon signature of the governor or lapse of time for gubernatorial action.
