SENATE BILL NO. 37

HEALTH CARE.  Provides for recognition of waiver services granted to military parents
transferred to Louisiana. (8/1/16)
1	AN ACT
2 To amend and reenact R.S. 28:827(B), (C), and (D) and to enact R.S. 28:827(E), relative to
3 certain Medicaid waiver programs; to provide with respect to certain Medicaid
4 waiver services for children of active duty military members in Louisiana; to provide
5 for an effective date; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 28:827(B), (C), and (D) are hereby amended and reenacted and R.S.
8 28:827(E) is hereby enacted to read as follows:
9 ยง827. Active duty military families

11	B. Any active duty member of the armed forces who has been assigned
12 to work in Louisiana and has a child that was receiving home- and community-
13 based waiver services in their state of deployment immediately before coming
14 to Louisiana shall be eligible to receive the next available slot for waiver services
15 upon establishing residency in Louisiana and being determined eligible for
16 Medicaid coverage in Louisiana.
17	B. C. For the purposes of this Section, the definition of "immediate family"

1 includes spouse, child, or other person for whom the member of the armed services
2 has guardianship.
3	C. D. The provisions of this Section shall be subject to approval by the
4 Centers for Medicare and Medicaid Services.
5	D E. The Department of Health and Hospitals may adopt rules and
6 regulations in accordance with the Administrative Procedure Act as the department
7 deems necessary to administer and implement the provisions of this Section.
8 Section 2.  This Act shall become effective on August 1, 2016; if vetoed by the
9 governor and subsequently approved by the legislature, this Act shall become effective on
10 August 1, 2016, or on the day following such approval by the legislature, whichever is later.

Present law provides that any active duty member of the armed forces who has been
temporarily assigned to work outside of Louisiana and any member of his immediate family
who has qualified for and has received Louisiana Medicaid waiver services provided under
the New Opportunities Waiver, the Children's Choice Waiver, or any other Medicaid home-
and community-based waiver, serving persons with developmental disabilities, shall be
eligible to receive the next available slot for waiver services upon the member's resumed
residence in Louisiana.
Proposed law establishes that any active duty member of the armed forces who has been
assigned to work in Louisiana and has a child that was receiving home- and community-
based waiver services in their immediate prior state of deployment before coming to
Louisiana shall be eligible to receive the next available slot for waiver services upon
establishing residency in Louisiana and being determined eligible for Medicaid coverage in
Louisiana.
