PUBLIC WORKS. Provides with respect to a contractor's surety bond for public works

1 AN ACT
2 To enact R.S. 38:2219(A)(1)(d), relative to the procurement of surety bonds and insurance;
3 to provide for a surety's defenses; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1. R.S. 38:2219(A)(1)(d) is hereby enacted to read as follows:
6 ยง2219. Procurement of surety bonds and insurance
7 A.(1) * * *
8 (d) A surety who provides a bond for a public works project shall be
9 entitled to rely on the defenses of the contractor, including but not limited to the
10 payment provisions contained in the contractor's contracts.
