Exempts motor carriers of nonhazardous oil field waste, nonhazardous industrial solid waste and hazardous waste from proving public convenience and necessity. (gov sig) 1 AN ACT 2 To amend and reenact R.S. 45:164(C), relative to common carrier's certificates; to exempt 3 certain motor carriers from proving public convenience and necessity; and to provide 4 for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 45:164(C) is hereby amended and reenacted to read as follows: 7 ยง164. Common carrier's certificate; contract carrier's permit 8 * * * 9 C. Wrecker and towing services, passenger carrying vehicles, household 10 goods movers, motor carriers of nonhazardous oil field waste, motor carriers of 11 nonhazardous industrial solid waste, motor carriers of hazardous waste, and 12 motor carriers of salt water utilized in oil well exploration and production shall not 13 be required to prove public convenience and necessity when applying for a common 14 carrier certificate or contract carrier permit. 15 * * * 16 Section 2. DIGEST SB 399 Engrossed 2016 Regular Session Morrish Present law requires motor carriers to obtain a certificate of public convenience and necessity from the Louisiana Public Service Commission before they can operate as a common carrier, which requires an application, public hearing and a finding of public convenience and necessity by the commission. Present law provides that certain motor carriers are exempt from the requirement to prove public convenience and necessity prior to operating as a common carrier. Proposed law adds motor carriers of nonhazardous oil field waste, motor carriers of nonhazardous industrial solid waste, and motor carriers of hazardous waste to the list of motor carriers that are exempt from the public convenience and necessity requirements.
