SENATE BILL NO. 41

FUNDS/FUNDING.  Increases supplemental pay for certain eligible law enforcement
officers and firefighters to $1,000 per month. (7/1/16)
1	AN ACT
2 To amend and reenact R.S. 40:1666.1(A)(1) and (4)(a), 1667.1(A)(1) and (2)(a), 1667.7(B)
3 and (G), and 1667.9, all relative to supplemental salaries for firefighters and law
4 enforcement officers; to increase the amount of supplemental salaries of certain
5 eligible firefighters and law enforcement officers; to provide for an effective date;
6 and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 40:1666.1(A)(1) and (4)(a), 1667.1(A)(1) and (2)(a), 1667.7(B) and
9 (G), and 1667.9 are hereby amended and reenacted to read as follows: 
10 §1666.1. Extra compensation
11	A.(1) In addition to the compensation now paid by any municipality, parish,
12 fire protection district, or other political subdivision maintaining a fire department,
13 or by the Chitimacha Tribe of Louisiana or the Coushatta Tribe of Louisiana,
14 hereinafter referred to as "tribe", or by any nonprofit corporation contracting with
15 any such political subdivision to provide fire protection services to every paid,
16 regularly employed employee who is paid not less than three hundred dollars per
17 month, not including supplemental pay, as distinguished from part-time employees

1 and volunteers of such fire department, who are carried on the payroll of such fire
2 department, and every employee as defined herein who is paid from funds of the
3 parish or municipality or tribe obtained through lawfully adopted bond issues,
4 lawfully assessed taxes, or other funds available for such purpose, either directly or
5 through a board or commission set up by law or ordinance of the parish or
6 municipality or tribe, shall be paid extra compensation by the state in the amount of
7 five hundred one thousand dollars per month for each such paid employee who has
8 completed or who hereafter completes one year of service. The provisions of
9 Paragraph (5) of this Subsection shall govern the requirements for length of service
10 for employees who were ordered to active military duty in the armed services of the
11 United States during their initial term of employment.

13	(4)(a) Every fire protection officer who is employed on a full-time basis by
14 a port authority headquartered in the city of New Orleans shall be paid by the state
15 extra compensation in the amount of five hundred one thousand dollars per month
16 in addition to the compensation now paid to him by his employer out of
17 self-generated revenue attributable to the agency employing such fire protection
18 officers. To be eligible for the extra compensation, each such fire protection officer
19 shall have completed one year of service, and any such fire protection officer hired
20 after March 31, 1986, shall also have completed and passed a certified fireman's
21 training program equal to National Fire Protection Association Standard 1001
22 Firefighter I Certification or a firemen's training program as approved by the
23 Louisiana State University Firemen Training Program in accordance with R.S.
24 40:1541 et seq., or other state or federally approved maritime firefighter training
25 program.

1 in this Part or by the Chitimacha Tribe of Louisiana, the Coushatta Tribe of
2 Louisiana, or the Tunica-Biloxi Tribe of Louisiana, hereinafter referred to as "tribe"
3 or "tribal", to any police officer, every police officer employed by any municipality
4 or tribe which employs one or more police officers who devotes his full working
5 time to law enforcement, and for those hired after March 31, 1986, who have
6 completed and passed a council-certified training program as provided in R.S.
7 40:2405, shall be paid by the state extra compensation in the amount of five hundred
8 one thousand dollars per month for each full-time municipal or tribal law
9 enforcement officer who has completed or who hereafter completes one year of
10 service.
11	(2)(a) Every sworn, commissioned law enforcement officer employed on a
12 full-time basis by a bona fide police agency of the state or its political subdivisions,
13 other than the Department of Public Safety and Corrections and the Department of
14 Wildlife and Fisheries, and headquartered in the city of New Orleans, and who
15 serves the welfare of the public in the capacity of a police officer by providing police
16 services to the general public through effecting arrests, issuing citations, and serving
17 warrants while patrolling levees, waterways and riverfront areas, or while patrolling
18 bridges that are within the boundaries of the city of New Orleans shall be paid by the
19 state extra compensation in the amount of five hundred one thousand dollars per
20 month in addition to the compensation now paid to him by his employer out of
21 self-generated revenue attributable to the agency employing such officers. To be
22 eligible for the extra compensation, each such law enforcement officer shall have
23 completed one year of service, and any such law enforcement officer hired after
24 March 31, 1986, shall also have completed and passed a council-certified training
25 program, as provided in R.S. 40:2405.

1	B. Out of the funds appropriated by the legislature for the payment of the
2 extra compensation provided by Subsection A of this Section, there shall be
3 distributed to the sheriff of each parish monthly to pay additional compensation for
4 full-time commissioned deputy sheriffs, and for those hired after March 31, 1986,
5 who have completed and passed a council-approved training program as provided
6 in R.S. 40:2405 and who are paid a salary of not less than three hundred fifty dollars
7 per month, the amount of five hundred one thousand per month for each full-time
8 commissioned deputy sheriff at the completion of one year of service.

10	G. Notwithstanding the provisions of Subsections A and B of this Section,
11 any full-time deputy sheriff employed as a field representative or process server and
12 who is paid a salary of not less than three hundred fifty dollars per month shall be
13 entitled to receive extra compensation in the amount of five hundred one thousand
14 per month at the completion of one year of service. However, to be eligible for such
15 extra compensation, a field representative or process server shall have completed and
16 passed a council-approved training program as provided in R.S. 40:2405.

18 §1667.9. Extra compensation for commissioned full-time harbor police, fireboat
19	personnel, and bridge police
20	In addition to the compensation now paid to any harbor police officer,
21 fireboat operator, and bridge police officer, every harbor police officer, fireboat
22 employee, and bridge police officer who is a full-time employee and who is paid a
23 salary of not less than eight hundred dollars per month and who has completed and
24 passed a post-certified training program as provided in R.S. 40:2405 and who has
25 completed or who hereafter completes one year of service shall be paid by the state
26 extra compensation in the amount of five hundred one thousand dollars per month.
27 The provisions of this Section shall only apply to employees of a political
28 subdivision of the state.
29 Section 2.  This Act shall become effective on July 1, 2016; if vetoed by the governor

1 and subsequently approved by the legislature, this Act shall become effective on July 1,
2 2016, or on the day following such approval by the legislature, whichever is later.

Present law provides for supplementary pay of $500 per month for any regularly employed
firefighter who is paid not less than three hundred dollars per month by any municipality,
parish, fire protection district or other political subdivision maintaining a fire department or
by the Chitimacha Tribe of Louisiana or Coushatta Tribe of Louisiana, or any nonprofit
corporation contracting with any political subdivision and has completed one year of service.
Also provides supplemental pay for certain full-time firefighters with the New Orleans port
authority.
Proposed law increases the supplemental pay from $500 per month to $1,000 for such
eligible firefighters.
Present law provides for supplementary pay of $500 per month paid by any municipality or
by the Chitimacha Tribe of Louisiana, Coushatta Tribe of Louisiana, or the Tunica-Biloxi
Tribe of Louisiana to any police officer who devotes his full working time to law
enforcement and has passed a council-certified training program and has completed one year
of service. Also includes certain police officers providing services while patrolling levees,
waterways, riverfront areas, and bridges within the city of New Orleans.
Proposed law increases the supplemental pay from $500 per month to $1,000 for such
eligible police officers.
Present law provides for supplementary pay of $500 per month paid to any sheriff for any
full-time commissioned deputy sheriff who has passed a council-certified training program
and who is paid a salary of not less than $350 per month and has completed one year of
service. Also includes a full-time deputy sheriff employed as a field representative or
process server.
Proposed law increases the supplemental pay from $500 per month to $1,000 for such
eligible sheriff deputies.
Present law provides for supplementary pay of $500 per month paid to any harbor and bridge
police officer who is a full-time employee and has passed a council-certified training
program and who is paid a salary of not less than $800 per month and has completed one
year of service. This shall only apply to employees of a political subdivision of the state. 
Proposed law increases the supplemental pay from $500 per month to $1,000 for such
eligible police officers.
Effective July 1, 2016.
