SENATE BILL NO. 52

MEDICAID.  Provides for the creation of a single preferred drug list for reimbursement of
Medicaid covered outpatient drugs. (gov sig)
1	AN ACT
2 To amend and reenact the introductory paragraph of R.S. 46:153.3(B)(2)(a), relative to the
3 Medicaid pharmacy program; to provide for an effective date; and to provide for
4 related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. The introductory paragraph of R.S. 46:153.3(B)(2)(a) is hereby amended
7 and reenacted to read as follows: 
8 ยง153.3. Medical vendor reimbursements; allowable restrictions; peer-based
9	prescribing and dispensing practice patterns; Medicaid

14	(2)(a) The department may shall establish a single preferred drug list that
15 utilizes may utilize a prior approval process or any other process or combination of
16 processes that prove to be cost-effective in the medical assistance program. This
17 single preferred drug list shall be developed by the department and utilized in

1 the medical assistance program, including all capitated Medicaid managed care
2 programs. At a minimum any prior approval process shall meet all of the following
3 criteria:

5 Section 2. This Act shall become effective upon signature by the governor or, if not
6 signed by the governor, upon expiration of the time for bills to become law without signature
7 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
8 vetoed by the governor and subsequently approved by the legislature, this Act shall become
9 effective on the day following such approval.

Present law provides that DHH may establish a drug list that utilized a prior authorization
process.
Proposed law provides that DHH shall establish a single preferred drug list that may utilize 
prior authorization.
Proposed law establishes a single preferred drug list developed by DHH that applies to the
managed care plans providing services pursuant to a contract with DHH. 
Effective upon signature of the governor or lapse of time for gubernatorial action.
