SENATE BILL NO. 80

1 A JOINT RESOLUTION
2 Proposing to add Article VIII, Section 7.2 of the Constitution of Louisiana, relative to
3 postsecondary education; to authorize certain postsecondary education management
4 boards to establish the tuition and mandatory fee amounts charged by the institutions
5 under their supervision and management; and to specify an election for submission
6 of the proposition to electors and provide a ballot proposition.
7 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members
8 elected to each house concurring, that there shall be submitted to the electors of the state, for
9 their approval or rejection in the manner provided by law, a proposal to add Article VIII,
10 Section 7.2 of the Constitution of Louisiana, to read as follows:
11 ยง7.2. Postsecondary Education Management Boards; Tuition and Fee
12 Authority
13 Section 7.2. Notwithstanding the provisions of Article VII, Section 2.1(A)
14 or any other provision of this constitution to the contrary, the Board of
15 Supervisors of Louisiana State University and Agricultural and Mechanical
16 College, the Board of Supervisors of Southern University and Agricultural and
17 Mechanical College, the Board of Supervisors for the University of Louisiana
18 System, and the Board of Supervisors of Community and Technical Colleges
19 shall have the authority to establish the tuition and mandatory fee amounts
20 charged by the institutions under their respective supervision and management
21 without legislative approval.
22 Section 2. Be it further resolved that this proposed amendment shall be submitted to
23 the electors of the state of Louisiana at the statewide election to be held on November 8,
24 2016.

1 Section 3. Be it further resolved that on the official ballot to be used at said election
2 there shall be printed a proposition, upon which the electors of the state shall be permitted
3 to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
4 follows:
5 Do you support an amendment to authorize the postsecondary education
6 management boards to establish the tuition and mandatory fee amounts
7 charged by institutions under their supervision and management, without
8 legislative approval?
