BY REPRESENTATIVE HENRY
1	AN ACT
2 To appropriate funds and to make certain reductions in appropriations from certain sources
3 to be allocated to designated agencies and purposes in specific amounts for the
4 making of supplemental appropriations for Fiscal Year 2016-2017; to provide for an
5 effective date; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  The following sums are hereby appropriated from the sources specified
8 and in the amounts specified for the purpose of making supplemental appropriations for
9 Fiscal Year 2016-2017.  Reductions are denoted in parentheses.

34 Provided, however, that the appropriation contained in Act No. 17 of the 2016 Regular
35 Session out of the Louisiana Legislature in the amount of $17,000,000 for the thirteenth
36 managed care payment in Fiscal Year 2016-2017 when the Department of Revenue prevails
37 in the suit, appeal, or petition associated with the legislative instrument which originated as
38 House Concurrent Resolution No.8 of the 2015 Regular Session of the Legislature and
39 transfer the amount paid in protest and held in escrow in accordance with R.S. 47:1576 to
40 the State General Fund, and in the event the monies are recognized by the Revenue
41 Estimating Conference to be utilized to fund the thirteenth managed care payment, is null,
42 void, and of no effect, and the state treasurer shall not honor warrants thereon.

33 16 of the 2016 Second Extraordinary Session of the Louisiana Legislature are adopted and
34 incorporated by reference for the appropriations contained in these Sections 3A, 3B, 3C, 3D,
35 3E, 3F, and 3G.  
36 Section 3B. Notwithstanding any provision of law to the contrary, including the
37 provisions of the Capital Outlay Act, the appropriation contained in Act 16 of the 2016

13	Section 3C. Notwithstanding any provision of law to the contrary, including the
14 provisions of the Capital Outlay Act, the appropriation contained in Act 16 of the 2016
15 Second Extraordinary Session of the Louisiana Legislature for Legislative Expenses,
16 Legislative Budgetary Control Council, State Capitol Security Improvements, Planning and
17 Construction (East Baton Rouge) is hereby amended and reenacted to read as follows:
18	On page 49, delete line 15 in its entirety, and insert the following:
19	"Priority 1	$2,667,900
20            Payable from the balance of State General Fund (Direct) 
21	Non-Recurring Revenues previously allocated under the 
22	authority of Act 23 of 2012 for Division of Administration,

30 provisions of the Capital Outlay Act, the appropriation contained in Act 16 of the 2016
31 Second Extraordinary Session of the Louisiana Legislature for Secretary's Emergency Fund
32 for Bridge Damages, Other Reimbursements, Local Matching Dollars, Federal Funds, and
33 Opportunity Grants Subject to the Provisions of R.S. 48:232 (Statewide), is hereby amended
34 and reenacted to read as follows:

19 The appropriation of monies in this Section shall be deemed to be and constitute approval

21	Section 3F.  Notwithstanding any provision of law to the contrary, including the
22 provisions of the Capital Outlay Act, the appropriation contained in Act 16 of the 2016
23 Second Extraordinary Session of the Louisiana Legislature for Department of Education,
24 McNeese State University, Drew Hall Parking Lot Reconstruction, Planning and
25 Construction (Calcasieu) is hereby amended and reenacted to read as follows:
26	On page 43, delete line 17, and insert the following:
27	"Payable from Fees and Self Generated Revenues          $1,520,000"
28 The appropriation of monies in this Section shall be deemed to be and constitute approval
29 by the Joint Legislative Committee on the Budget.
30	Section 3G.  The following sum is hereby appropriated from the source specified
31 and in the amount specified for the purpose of making supplemental capital outlay
32 appropriations for Fiscal Year 2016-2017.

8 Section 4A.  Notwithstanding any provisions of law to the contrary, any
9 appropriation contained in Schedule 20-901 Sales Tax Dedications or Schedule 20-945 State
10 Aid to Local Governmental Entities, in Act No. 17 of the 2016 Regular Session of the
11 Legislature which appropriation has a valid Cooperative Endeavor Agreement on June 30,
12 2017, shall be deemed a bona fide obligation through December 31, 2017 and all other
13 provisions of the Cooperative Endeavor Agreements, including but not limited to, the
14 reporting requirements, shall be performed as agreed.
15 Section 4B.   Notwithstanding any provision of law to the contrary, any appropriation
16 contained in Other Requirements, Schedule 20-901 Sales Tax Dedications in Act 14 of the
17 2013 Regular Session of the Legislature for the Town of Delhi for the Cave Theater in the
18 amount of $20,000 shall be deemed a bona fide obligation through June 30, 2018 and all
19 provisions of the Cooperative Endeavor Agreement executed between the Town of Delhi and
20 the Department of the Treasury, including but not limited to the requirements shall be
21 performed as agreed.
22 Section 4C.  Notwithstanding any provision of law to the contrary, any appropriation
23 contained in Other Requirements, Schedule 20-901 Sales Tax Dedications in Act 54 of the
24 2013 Regular Session of the Legislature for the Town of Arnaudville in the amount of
25 $20,000 shall be deemed a bona fide obligation through June 30, 2018 and all provisions of
26 the Cooperative Endeavor Agreement executed between the Town of Arnaudville and the
27 Department of the Treasury, including but not limited to the requirements shall be performed
28 as agreed.
29 Section 5. Notwithstanding any provision of law to the contrary, any appropriation
30 payable with Statutory Dedications out of the State Emergency Response Fund or Statutory
31 Dedications out of the Overcollections Fund contained in Schedule 01-112 Department of
32 Military Affairs, Schedule 08A Department of Corrections, Schedule 09-306 Medical
33 Vendor Payments, Schedule 10-360 Department of Children and Family Services, and

1 Schedule 19-610 Louisiana State University Health Sciences Center Health Care Services
2 Division in this bill shall be deemed a bona fide obligation through June 30, 2018.  Any such
3 appropriation shall be subject to the recognition by the Revenue Estimating Conference of
4 such funds being available.
5 Section 6.  This Act shall become effective upon signature by the governor or, if not
6 signed by the governor, upon expiration of the time for bills to become law without signature
7 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
8 vetoed by the governor and subsequently approved by the legislature, this Act shall become
9 effective on the day following such approval.
