HOUSE BILL NO. 314
BY REPRESENTATIVES THOMAS, BILLIOT, MARINO, AND STOKES
Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana.
HOSPITALS:  Requires LSU hospitals and public-private partnership hospitals to accept
certain patients transferred by other hospitals
1	AN ACT
2To enact R.S. 17:1519.4.1, relative to state hospitals operated by the Board of Supervisors
3 of Louisiana State University and Agricultural and Mechanical College and nonstate
4 public-private partnership hospitals; to require such hospitals to accept transfers of
5 certain patients; to provide relative to transfers of certain patients to such hospitals
6 by other hospital facilities; to provide relative to health care for persons who are
7 enrolled in Medicaid or medically indigent; to provide a legislative declaration; and
8 to provide for related matters.
9Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 17:1519.4.1 is hereby enacted to read as follows:
11 ยง1519.4.1.  Operations of Louisiana State University Health Sciences Center
12	hospitals and public-private partnership hospitals; acceptance of certain
13	transferred patients
14	A.  For purposes of this Section, the following terms have the meaning
15 ascribed in this Subsection:
16	(1)  "LSU hospital" means a hospital for which a Louisiana State University
17 Health Sciences Center is responsible pursuant to R.S. 17:1519.2(B).
18	(2)  "Public-private partnership hospital" means a nonstate privately owned
19 and operated hospital or a partner entity that operates a hospital listed in R.S.
20 17:1519.2(B) pursuant to a cooperative endeavor agreement, contract, or any other

1 type of agreement with the Board of Supervisors of Louisiana State University and
2 Agricultural and Mechanical College or with any other board, commission, agency,
3 department, or office of this state.
4	B.  No LSU hospital or public-private partnership hospital shall refuse to
5 accept for treatment any patient who is transferred to the hospital by any other
6 facility licensed in accordance with the Hospital Licensing Law, R.S. 40:2100 et
7 seq., and who meets either of the following criteria:
8	(1)  Is a Medicaid enrollee.
9	(2)  Is medically indigent.
10	C.  The provisions of this Section shall apply to each hospital listed in R.S.
11 17:1519.2(B) regardless of whether the hospital is operated by a Louisiana State
12 University Health Sciences Center as an LSU hospital or is operated as a public-
13 private partnership hospital.
14	D.  The requirement established in this Section for acceptance of transferred
15 patients who are Medicaid enrollees or medically indigent is hereby declared to be
16 consistent with the objects and purposes of the Louisiana State University Health
17 Sciences Centers provided in R.S. 17:1517 and 1519.4.

Abstract:  Requires LSU hospitals and public-private partnership hospitals to accept
Medicaid enrollees and indigent patients transferred by other hospitals.
Proposed law provides the following definitions for purposes of proposed law:
(1)"LSU hospital" means a hospital for which a Louisiana State University (LSU)
Health Sciences Center is responsible pursuant to present law, R.S. 17:1519.2(B).
(2)"Public-private partnership hospital" means a nonstate privately owned and operated
hospital or a partner entity that operates a hospital listed in present law, R.S.
17:1519.2(B), pursuant to a cooperative endeavor agreement, contract, or any other
type of agreement with the LSU Board of Supervisors or with any other board,
commission, agency, department, or office of this state.

Proposed law prohibits each LSU hospital and public-private partnership from refusing to
accept for treatment any patient who is transferred to the hospital by any other state-licensed
hospital facility, and who meets either of the following criteria:
(1)Is a Medicaid enrollee.
(2)Is medically indigent.
Proposed law provides a declaration that the requirement established in proposed law for
acceptance of Medicaid enrollees and medically indigent patients is consistent with the
objects and purposes of the LSU Health Sciences Centers provided in present law, R.S.
17:1517 and 1519.4.
