ENROLLED ACT No. 216 2017 Regular Session HOUSE BILL NO. 379 BY REPRESENTATIVE BAGNERIS 1 AN ACT 2 To enact R.S. 48:1660.1, relative to the Regional Transit Authority; to authorize the use of 3 public-private partnership contracts by the authority for certain projects; to provide 4 for procedure; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 48:1660.1 is hereby enacted to read as follows: 7 ยง1660.1. Public-private partnership projects 8 A. Notwithstanding any law to the contrary or the requirements of this Part, 9 if the board of commissioners determines it is in the best interest of the taxpayers, 10 the Regional Transit Authority, with approval of the House and Senate 11 transportation, highways, and public works committees, may solicit proposals for 12 and enter into contracts for public-private partnership projects for a transportation 13 facility as defined in R.S. 48:2073, provided the authority shall comply with the 14 provisions of R.S. 48:2084 through 2084.15 that are applicable to public-private 15 partnership projects of the Louisiana Transportation Authority. However, R.S. 16 48:256.3 and 256.5 shall be applicable in the same manner as any other department 17 projects. 18 B. The authority shall not receive an unsolicited proposal for a public-private 19 partnership project. 20 Section 2. This Act shall become effective upon signature by the governor or, if not 21 signed by the governor, upon expiration of the time for bills to become law without signature 22 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
