HLS 17RS-498 ENGROSSED 2017 Regular Session HOUSE BILL NO. 443 BY REPRESENTATIVE STOKES FUNDS/FUNDING: (Constitutional Amendment) Dedicates revenue to fund the inspector general's office 1 A JOINT RESOLUTION 2Proposing to add Article VII, Section 10.17 of the Constitution of Louisiana, to provide for 3 funding for the office of the state inspector general; to create a fund and to dedicate 4 sales tax revenue to such purpose; to provide for submission of the proposed 5 amendment to the electors; and to provide for related matters. 6 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members 7elected to each house concurring, that there shall be submitted to the electors of the state of 8Louisiana, for their approval or rejection in the manner provided by law, a proposal to add 9Article VII, Section 10.17 of the Constitution of Louisiana, to read as follows: 10 §10.17. Inspector General Fund 11 Section 10.17(A) There shall be established in the state treasury the 12 Inspector General Fund to provide greater independence for the office of the state 13 inspector general by providing a dedicated, recurring source of revenues for 14 financing the office of the state inspector general and the activities of that office. 15 (B)(1) Out of the funds remaining in the Bond Security and Redemption Fund 16 after a sufficient amount is allocated from that fund to pay all obligations secured by 17 the full faith and credit of the state which become due and payable within any fiscal 18 year as required by Article VII, Section 9(B) of this constitution, the treasurer shall 19 deposit in and credit to the Inspector General Fund from revenues received by the Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 17RS-498 ENGROSSED HB NO. 443 1 state from sales and use taxes an amount of revenue determined as provided in 2 Subparagraph (2) of this Paragraph. 3 (2) For Fiscal Year 2018-2019, the treasurer shall deposit two million dollars 4 into the fund. For each subsequent fiscal year, the treasurer shall deposit an amount 5 determined by adjusting the amount deposited in the previous fiscal year by the 6 amount of increase in the Consumer Price Index, United States city average for all 7 urban consumers, as prepared by the United States Department of Labor, Bureau of 8 Labor Statistics, for the calendar year immediately preceding the adjustment. 9 (C) All unexpended and unencumbered monies in the fund at the end of the 10 fiscal year shall remain in the fund. The money in the fund shall be invested as 11 provided by law and any earnings realized on investment of money in the fund shall 12 be deposited in and credited to the fund. Money from other sources, such as 13 donations, appropriations, or dedications, may be deposited in and credited to the 14 fund. 15 (D) The money in the fund shall be appropriated for purposes of funding the 16 office of the state inspector general and the activities of that office. No appropriation 17 shall be made from the fund inconsistent with this purpose. 18 Section 2. Be it further resolved that this proposed amendment shall be submitted 19to the electors of the state of Louisiana at the statewide election to be held on October 14, 202017. 21 Section 3. Be it further resolved that on the official ballot to be used at the election, 22there shall be printed a proposition, upon which the electors of the state shall be permitted 23to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as 24follows: 25 Do you support an amendment to provide greater independence for the state 26 inspector general by dedicating a minimum level of funding to the office of 27 the state inspector general and the activities of that office?
