HOUSE BILL NO. 547

MTR VEHICLE/DRIVER LIC:  Provides for an additional fee on driver's license
applications to benefit the Military Family Assistance Fund
1	AN ACT
2To amend and reenact R.S. 32:412(A)(1), (2), (5), (6), (B)(1), (2), (7)(e)(i)(aa), (cc), (dd)(I),
(ee), (ii)(aa), (cc), (dd)(I), and (ee) and R.S. 46:122(A)(1),  3	relative to driver's license
4 fees; to provide for a one dollar increase in driver's license fees to benefit the
5 Louisiana Military Family Assistance Fund; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 32:412(A)(1), (2), (5), (6), (B)(1), (2), (7)(e)(i)(aa), (cc), (dd)(I), (ee),
8(ii)(aa), (cc), (dd)(I), and (ee) are hereby amended and reenacted to read as follows:
9 §412.  Amount of fees; credit or refund; duration of license; veteran designation;
10	disabled veteran designation; university logo; "I'm a Cajun" designation;
11	disbursement of funds; renewal by mail or electronic commerce of Class "D"
12	or "E" drivers' licenses; disposition of certain fees; exception
13	A.(1)  Every applicant for a Class "D" driver's license, or for a renewal of a
14 Class "D" driver's license, except those bona fide residents of the city of New
15 Orleans, shall pay for such basic license a fee of forty-two forty-three dollars and
16 seventy-five cents.  Eleven dollars and fifteen cents of the fee shall be paid to the
17 Louisiana State Police Retirement System Fund.  One dollar and fifty cents of the fee
18 shall be forwarded by the department to the litter abatement and education account
19 which is created with the Conservation Fund through the provisions of R.S.

1 56:10(B)(15). One dollar of the fee shall be paid to the Louisiana Military Family
2 Assistance Fund.
3	(2)  The fee for Class "D" driver's licenses, or renewal of a  Class "D" driver's
4 license, issued to bona fide residents of the city of New Orleans shall be fifty-four 
5 fifty-five dollars, fifteen dollars of which shall be payable by the department to the
6 board of trustees of the police pension fund of the city of New Orleans.  One dollar
7 and eighty-four cents of the fee shall be paid to the Louisiana State Police Retirement
8 System Fund.  One dollar and fifty cents of the fee shall be forwarded by the
9 department to the litter abatement and education account which is created within the
10 Conservation Fund through the provisions of R.S. 56:10(B)(15). One dollar of the
11 fee shall be paid to the Louisiana Military Family Assistance Fund.

13	(5)  Every applicant for a Class "E" driver's license, or for a renewal of a
14 Class "E" driver's license, except those bona fide residents of the city of New
15 Orleans, shall pay for such basic license a fee of twenty twenty-one dollars and
16 twenty-five cents, which shall be the cost of such basic license.  Five dollars and
17 sixty-three cents of the fee shall be paid to the Louisiana State Police Retirement
18 System Fund.  One dollar and fifty cents of the fee shall be forwarded by the
19 department to the litter abatement and education account which is created within the
20 Conservation Fund through the provisions of R.S. 56:10(B)(15). One dollar of the
21 fee shall be paid to the Louisiana Military Family Assistance Fund.
22	(6)  The fee for a Class "E" driver's license, or renewal of a Class "E" driver's
23 license, issued to bona fide residents of the city of New Orleans shall be twenty 
24 twenty-one dollars and twenty-five cents, three dollars and seventy-five cents of
25 which fee shall be paid by the department to the board of trustees of the police
26 pension funds of the city of New Orleans.  Three dollars and seventy-five cents of
27 the fee shall be paid to the Louisiana State Police Retirement System Fund.  One
28 dollar and fifty cents of the fee shall be forwarded by the department to the litter
29 abatement and education account which is created within the Conservation Fund

1 through the provisions of R.S. 56:10(B)(15). One dollar of the fee shall be paid to the
2 Louisiana Military Family Assistance Fund.

4	B.(1)  Every applicant for a Class "A", "B", or "C" commercial driver's
5 license, or for a renewal of a basic Class "A", "B", or "C" commercial driver's
6 license, except for those bona fide residents of the city of New Orleans, shall pay for
7 such basic license a fee of sixty-one sixty-two dollars and fifty cents.  Sixteen dollars
8 and twenty cents of the fee shall be paid to the Louisiana State Police Retirement
9 System Fund.  One  dollar and fifty cents of the fee shall be forwarded by the
10 department to the litter abatement and education account which is created within the
11 Conservation Fund through the provisions of R.S. 56:10(B)(15). One dollar of the
12 fee shall be paid to the Louisiana Military Family Assistance Fund.
13	(2)  The fee for a basic Class "A", "B", or "C" commercial driver's license,
14 or for the renewal of a basic Class "A", "B", or "C" commercial driver's license,
15 issued to bona fide residents of the city of New Orleans shall be seventy-six 
16 seventy-seven dollars and fifty cents, fifteen dollars of which fee shall be paid by the
17 department to the board of trustees of the police pension fund of the city of New
18 Orleans.  Fifteen dollars of the fee shall be paid to the Louisiana State Police
19 Retirement System Fund.  One dollar and fifty cents of the fee shall be forwarded by
20 the department to the litter abatement and education account which is created with
21 the Conservation Fund through the provisions of R.S. 56:10(B)(15). One dollar of
22 the fee shall be paid to the Louisiana Military Family Assistance Fund.

14 two twenty-three dollars and thirteen cents, which shall be the cost of the license. 
15 The license shall expire on the anniversary of the birthday of the applicant which is
16 nearest to the date of six years subsequent to the issuing of the license, unless
17 revoked, canceled, or suspended.

19	(ee)  Five dollars and fifty-six cents of the fee shall be paid to the Louisiana

25	(ii)(aa)  Every applicant seventy years of age or older for a Class "E" driver's
26 license, or for the renewal of a Class "E" driver's license, issued to bona fide
27 residents of the city of New Orleans, shall pay for such basic license a fee of six
28 seven dollars and seventy-five cents, which shall be the cost of the license.  This
29 license shall expire on the anniversary of the birthday of the applicant which is

9 through the provisions of R.S. 56:10(B)(15). One dollar of the fee shall be paid to the

11	(dd)(I)  Every applicant seventy years of age or older for a Class "D" driver's
12 license, or for the renewal of a Class "D" driver's license, issued to bona fide
13 residents of the city of New Orleans, shall pay for such basic license a fee of twenty-
14 seven twenty-eight dollars and seventy-five cents, which shall be the cost of the
15 license.  This license shall expire on the anniversary of the birthday of the applicant
16 which is nearest to the date of six years subsequent to the issuing of the license,
17 unless revoked, canceled, or suspended.

20 department to the board of trustees of the police pension fund of the city of New
21 Orleans.  Ninety-two cents of the fee shall be paid to the State Police Pension and
22 Retirement Fund.  One dollar and fifty cents of the fee shall be forwarded by the
23 department to the litter abatement and education account which is created within the
24 Conservation Fund through the provisions of R.S. 56:10(B)(15). One dollar of the
25 fee shall be paid to the Louisiana Military Family Assistance Fund.

1	A.(1)  Funds received by the state treasurer pursuant to the provisions of R.S.
2 47:120.31 and 306.3, or received by the treasurer or the Louisiana Military Family
3 Assistance Board from other public or private donations, gifts, grants, appropriations
4 or other revenue, including revenue derived from driver's license fees, shall be
5 deposited and credited to a special fund hereby created in the state treasury to be
6 known as the Louisiana Military Family Assistance Fund.  The money in the fund
7 shall be used solely as provided for in Subsection B of this Section.  In addition to
8 funds from any other source, public or private donations, gifts, or grants from
9 individuals, corporations, nonprofit organizations, or other business entities may be
10 made to the fund and accepted by the fund for military family relief and assistance
11 as provided in this Part.

city of New Orleans.  Present law further provides for the distribution of the fee according
to present law.
Proposed law increases the class "D" driver's license fee from $42.75 to $43.75, except for
residents of the city of New Orleans.  Proposed law further provides for the distribution of
the additional $1.00 to the La. Military Family Assistance Fund (fund).
Present law provides for a class "D" driver's license fee of $54.00 for residents of the city
of New Orleans.  Present law further provides for the distribution of the fee according to
present law.
Proposed law increases the class "D" driver's license fee from $54.00 to $55.00 for residents
of the city of New Orleans.  Proposed law further provides for the distribution of the
additional $1.00 to the fund.
Present law provides for a class "E" driver's license fee of $20.25, except for residents of the
