DISTRICTS/DRAINAGE: Provides relative to the Statewide Flood-Control Program 1 AN ACT 2To amend and reenact R.S. 38:90.2(A) and 90.4(A)(1) and to enact R.S. 38:90.2(C), relative 3 to the Statewide Flood Control Program; to provide for penalties for failing to 4 perform required actions; to require the submission of an application by any duly 5 authorized municipal, parish, or other governing authority after; and to provide for 6 related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 38:90.2(A) and 90.4(A)(1) are hereby amended and reenacted and 9R.S. 38:90.2(C) is hereby enacted to read as follows: 10 §90.2. Revision of flood information data base database 11 A. At least once in every four three years, beginning with fiscal year 1982-83 12 2017-2018, the Louisiana Geological Survey shall review and revise the statewide 13 flood information data base. The data base will be developed for the purpose of the 14 systematic evaluation of drainage and flooding problems in the state. 15 * * * 16 C. If the Louisiana Geological Survey fails to perform their review and 17 revision of the statewide flood information database as required in Subsection A of 18 this Section, they shall be required to report to the House and Senate Committees on 19 Transportation, Highways and Public Works prior to the beginning of the regular 20 legislative session to inform the committees of the specific reason for such failure. HLS 17RS-1139 ORIGINAL HB NO. 605 1 At the close of the meeting, the committee shall determine whether to request the 2 appropriate governing authority to withhold a certain amount of the survey's 3 appropriations until the review and revision of the statewide flood information 4 database has been completed. 5 * * * 6 §90.4. Methodology for flood-control project evaluation 7 A.(1) Applications for funding of any flood-control projects under the 8 Statewide Flood Control Program may be submitted by any duly authorized 9 municipal, parish, or other governing authority. Applications shall be made to the 10 office of engineering by October first of each year, for consideration of funding in 11 the following fiscal year. In the event that a disaster declaration has been issued by 12 the governor for a municipality or parish, the governing authority of the municipality 13 or parish shall submit an application to the office of engineering by October first of 14 the year following the declaration. Applications submitted in accordance with the 15 provisions of this Chapter shall not be subject to the provisions of R.S. 39:101. 16 Sponsoring authorities with a population of fifty thousand persons or more shall be 17 responsible for the preparation of applications for their respective projects. For 18 sponsoring authorities with a population of less than fifty thousand persons, the 19 office shall prepare the applications for the projects, or the sponsoring authority may 20 prepare its application in the event the office cannot accomplish required engineering 21 services in a timely manner. Geological Survey to review and revise the statewide flood information data base at least once very four years. Proposed law modifies present law by changing the time frame from once every four years to once every three years. Proposed law provides that if the La. Geological Survey does not review and revise the statewide flood information database as required in present law, they must provide a reason to the House and Senate committees on Transportation explaining the failure. Proposed law allows the committee to request the governing authority of the La. Geological Survey withhold appropriations to the survey until the review and revisions are complete. Present law provides that any duly authorized municipal, parish, or other governing authority may submit an application for funding of any flood-control projects under the Statewide Flood Control Plan to the office of engineering by October 1 st of each year. Proposed law provides that if a disaster declaration has been issued by the governor for a municipality or parish, the governing authority of that municipality or parish must submit an application as provided for in present law by October 1 st of the year following the declaration.
