HOUSE CONCURRENT RESOL UTION NO. 11

A CONCURRENT RESOL UTION
To memorialize the United States Congress to take such actions as are necessary to amend
Title XIX of the Social Security Act relative to the Medicaid program in order to
authorize state Medicaid fraud control units to investigate and prosecute Medicaid
recipient fraud.
WHEREAS, the annual cost of Louisiana's Medicaid program has grown to
approximately eleven billion dollars; and
WHEREAS, the Medicaid program  continues to grow at an increasing rate and now
encompasses well over one third of the operating budget of this state; and
WHEREAS, Louisiana has expanded its Medicaid program in accordance with
Public Law 111-148, the Patient Protection and Affordable Care Act; and
WHEREAS, actual enrollment into Louisiana's expanded Medicaid program has
exceeded initial projections by over one hundred thousand enrollees; and
WHEREAS, the Louisiana Legislative Auditor has determined that a number of
persons who enrolled in Medicaid were not eligible for benefits of the program; and
WHEREAS, this state currently does not police Medicaid recipient fraud effectively;
and
WHEREAS, the Medicaid Fraud Control Unit within the office of the attorney
general has the capability and expertise to investigate Medicaid recipient fraud and prosecute
cases of such fraud; and

WHEREAS, Medicaid fraud control units such as that of the Louisiana attorney
general are currently prohibited by provisions of Title XIX of the Social Security Act from
conducting investigations into Medicaid recipient fraud; and
WHEREAS, the office of the attorney general is the only Louisiana law enforcement
division with statewide jurisdiction that has the necessary expertise and capability to
investigate and prosecute Medicaid recipient fraud; and
WHEREAS, though this state has an indisputable interest in investigation and
prosecution of this form of Medicaid fraud, these actions are prohibited under the Social
Security Act.
THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
memorialize the United States Congress to take such actions as are necessary to amend Title
XIX of the Social Security Act relative to the Medicaid program in order to authorize state
Medicaid fraud control units to investigate and prosecute Medicaid recipient fraud.
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
presiding officers of the Senate and the House of Representatives of the Congress of the
United States of America and to each member of the Louisiana congressional delegation.
