CRIME/PUNISHMENT.  Provides an enhanced penalty for armed robbery or attempted
armed robbery of a drivers-sales worker. (gov sig)
1	AN ACT
2 To enact R.S. 14:64.5, relative to armed robbery; to provide an enhanced penalty when
3 committed upon a drivers-sales worker; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 14:64.5 is hereby enacted to read as follows:
6 ยง64.5.  Armed robbery and attempted armed robbery of drivers-sales worker;
7	mandatory penalty
8	A. When the crime of armed robbery is knowingly and intentionally
9 committed upon a drivers-sales worker while the worker is going to, at, or
10 returning from a delivery, the offender shall be imprisoned at hard labor for
11 twice the stated mandatory minimum for the offense without benefit of parole,
12 probation, or suspension of sentence.
13	B. When the crime of attempted armed robbery is knowingly and
14 intentionally committed upon a drivers-sales worker while the worker is going
15 to, at, or returning from a delivery, the offender shall be imprisoned at hard
16 labor for twice the stated mandatory minimum for the offense without benefit
17 of parole, probation, or suspension of sentence.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.

Present law provides that armed robbery is the taking of anything of value belonging to
another from the person of another or that is in the immediate control of another, by use of
force or intimidation, while armed with a dangerous weapon.  Present law provides that
whoever commits the crime of armed robbery shall be imprisoned at hard labor for not less
than 10 years and for not more than 99 years, without benefit of parole, probation, or
suspension of sentence. 
Proposed law provides that when an armed robbery or attempted armed robbery is
knowingly and intentionally committed upon a drivers-sales worker while the worker is
going to, at, or returning from a delivery, the offender shall be imprisoned at hard labor for
twice the stated mandatory minimum for the offense without benefit of parole, probation,
or suspension of sentence. 
Proposed law provides that when an attempted armed robbery is knowingly and intentionally
committed upon a drivers-sales worker while the worker is going to, at, or returning from
a delivery, the offender shall be imprisoned at hard labor for twice the stated mandatory
minimum for the offense without benefit of parole, probation, or suspension of sentence.
Effective upon signature of the governor or lapse of time for gubernatorial action.
