WATER/WATERWAYS. Provides an exception for portions of the Comite River, Pearl
River, Tchefuncte River, Bogue Falaya River, Abita River, Amite River, and Bayou
Manchac from provisions of the natural and scenic rivers program. (8/1/17)
1 AN ACT
2 To amend and reenact R.S. 56:1855(M)(2) and to enact R.S. 56:1855(O), relative to the
3 Louisiana Scenic Rivers Act; to provide for certain natural and scenic rivers; to
4 provide exceptions for certain uses on the Amite River, Pearl River, Tchefuncte
5 River, Bogue Falaya River, Abita River, Comite River, and Bayou Manchac; to
6 provide terms, conditions, and procedures; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 56:1855(M)(2) is hereby amended and reenacted and R.S.
9 56:1855(O) is hereby enacted to read as follows:

13 (2) Notwithstanding other provisions of R.S. 56:1853, clearing and
14 snagging, and dredging operations for drainage purposes, in Bayou Manchac shall
15 be permitted by the department. Any such permit shall be issued in accordance with
16 the requirements and procedures provided for in R.S. 56:1849.

1 O. Notwithstanding other provisions of R.S. 56:1853, clearing and
2 snagging, and dredging operations for drainage purposes, in the Amite River,
3 Pearl River, Tchefuncte River, Bogue Falaya River, Abita River, and Comite
4 River shall be permitted by the department. Any such permit shall be issued in
5 accordance with the requirements and procedures provided for in R.S. 56:1849.

Present law provides for prohibited uses on certain rivers in the Louisiana Scenic Rivers Act.
Further provides that the prohibited uses are channelization, clearing and snagging, channel
realignment, and reservoir construction.
Proposed law allows for the permitting of clearing and snagging, and dredging operations
for drainage purposes, in the Comite River, Pearl River, Tchefuncte River, Bogue Falaya
River, Abita River, Amite River, and Bayou Manchac.
Effective August 1, 2017.
