1	AN ACT
2 To amend and reenact R.S. 33:2011(A) and (B), relative to occupational diseases; to provide
3 with respect to firefighters; to provide for the classification of certain types of cancer
4 as occupational diseases or infirmities connected with the duties of a firefighter; and
5 to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 33:2011(A) and (B) are hereby amended and reenacted to read as
8 follows: 
9 ยง2011. Development of cancer during employment in fire service; occupational
10	disease
11	A. Because of exposure to heat, smoke, and fumes or carcinogenic,
12 poisonous, toxic, or chemical substances, when a firefighter in the classified service
13 who has completed ten or more years of service is unable to perform his regular
14 duties in the fire service in this state by reason of a disabling cancer, such cancer has
15 developed cancer, the cancer shall be classified as an occupational disease or
16 infirmity connected with the duties of a firefighter. The disease or infirmity shall be
17 presumed to have been caused by or to have resulted from the work performed. This
18 presumption shall be rebuttable by evidence meeting judicial standards, and shall be
19 extended to a member following termination of service for a period of three months
20 for each full year of service not to exceed sixty months commencing with the last
21 actual date of service.

1	B. The disabling cancer referred to in Subsection A of this Section shall be
2 limited to the types of cancer which may be caused by exposure to heat, smoke,
3 radiation, or a known or suspected carcinogen as defined by the International Agency
4 for Research on Cancer. The disabling cancer shall also be limited to a cancer
5 originating in the bladder, brain, colon, liver, pancreas, skin, kidney, or
6 gastrointestinal or reproductive tract, and leukemia, lymphoma, and multiple
7 myeloma, prostate cancer, and testicular cancer, or any other type of cancer,
8 due to occupational exposure, for which firefighters are determined to have a
9 statistically significant increased risk over that of the general population.
