SAFETY REGULATIONS.  Provides for legislative oversight and adoption of proposed
updates to the State Uniform Construction Code. (8/1/17)
1	AN ACT
2 To amend and reenact R.S. 40:1730.26(3) and to enact R.S. 40:1730.26(5), relative to the
3 State Uniform Construction Code; to provide for submission of updates to legislative
4 subject matter committees; to require approval of proposed updates by legislative
5 committees; to provide for procedures; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:1730.26(3) is hereby amended and reenacted and R.S.
8 40:1730.26(5) is hereby enacted to read as follows: 
9 ยง1730.26. Adoption and promulgation of certain building codes and standards as
10	State Uniform Construction Code; procedures
11	The council shall review, adopt, modify, and promulgate the building codes
12 referenced in R.S. 40:1730.28 and 1730.28.1 of this Part, provided that:

14	(3) The council shall review, evaluate, and update the State Uniform
15 Construction Code no later than five years from the date of publication of the
16 appropriate code as provided for in R.S. 40:1730.28. The council shall submit the
17 updated State Uniform Construction Code to the House Committee on Commerce

1 and the Senate Committee on Commerce, Consumer Protection, and International
2 Affairs for oversight and approval at least ten days prior to the last day for the
3 prefiling of legislation in the regular legislative session. Additionally, the council
4 shall provide the members of each house of the legislature a summary of the major
5 proposed changes to the International Residential Code at the time of submission to
6 the oversight committees.

8	(5) The proposed updated State Uniform Construction Code shall not
9 become effective until it is approved by the legislature by concurrent resolution
10 while in regular session. If the legislature fails to adopt the proposed updated
11 State Uniform Construction Code, the most recently approved State Uniform
12 Construction Code shall remain in effect until the legislature approves an
13 updated State Uniform Construction Code.

Present law provides for a State Uniform Construction Code ("code") and requires the La.
State Uniform Construction Code Council ("council") to review and update the code no later
than five years from the date of publication of the appropriate code. 
Present law requires the council to submit the updated code to the House Committee on
Commerce and the Senate Committee on Commerce, Consumer Protection, and International
Affairs for oversight and approval and requires the council to provide all legislative
members with a summary of the major proposed changes.
Proposed law retains present law but requires legislative oversight and approval of updates
to the code at least ten days prior to deadline for prefiling bills.
Proposed law provides that the code not become effective until it is approved by the
legislature by concurrent resolution while in regular session and if the legislature fails to
adopt the proposed updated code, the most recently approved code shall remain in effect
until the legislature approves an updated code.
Effective August 1, 2017.
