EDUCATION ACCOUNTABILITY.  Requires high school governing authorities to pay the
cost of certain postsecondary remedial and developmental coursework required of public
high school graduates. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 17:24.4(F)(1)(a) and to enact R.S. 17:24.4(L), relative to
3 elementary and secondary education; to provide relative to the Louisiana
4 Competency-Based Education Program; to provide relative to state content standards
5 and related assessments; to require the governing authority of each public high
6 school to ensure that certain students are college ready; to require each school
7 governing authority to reimburse certain public postsecondary institutions for the
8 cost of remedial and developmental coursework; and to provide for related matters.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 17:24.4(F)(1)(a) is hereby amended and reenacted and R.S.
11 17:24.4(L) is hereby enacted to read as follows:
12 ยง24.4. Louisiana Competency-Based Education Program; statewide standards for

16	F.(1)(a) The state Department of Education shall implement the Louisiana
17 Educational Assessment Program with the approval of the State Board of Elementary

1 and Secondary Education.

3	L.(1) The governing authority of each public high school shall ensure
4 that each student who graduates from high school after completing a college
5 preparatory curriculum has the basic knowledge and skills needed to undertake
6 entry-level postsecondary coursework as demonstrated by the student meeting
7 the college readiness benchmarks established by ACT for English and
8 mathematics.
9	(2) For a student who fails to meet the established college readiness
10 benchmarks and who is required to take remedial or developmental coursework
11 as a condition of admission or enrollment at a Louisiana public postsecondary
12 education institution, the institution may seek and receive reimbursement from
13 the governing authority of the public high school from which the student
14 graduated for the cost of providing the required remedial or developmental
15 coursework.
16	(3) The amount of reimbursement shall not exceed the postsecondary
17 institution's published tuition amount for the remedial or developmental
18 coursework undertaken.
19	(4) Reimbursement shall not be provided for a student to take the same
20 level of coursework more than once, whether or not the student completes the
21 course.
22	(5) Reimbursement shall not be provided for a student to take more than
23 two remedial or developmental courses.
24	(6) A public postsecondary education institution shall not receive
25 payment from both a student and a public school governing authority for the
26 same remedial or developmental coursework.
27	(7) The provisions of this Subsection shall apply only if the student
28 enrolls in a public postsecondary education institution and is required to take
29 remedial or developmental coursework during the academic year immediately

1 following graduation from high school.
2 Section 2.  This Act shall become effective upon signature by the governor or, if not
3 signed by the governor, upon expiration of the time for bills to become law without signature
4 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
5 vetoed by the governor and subsequently approved by the legislature, this Act shall become
6 effective on the day following such approval.

Present law provides for the La. Competency-Based Education Program, including the
implementation of statewide content standards for required subjects and the La. Educational
Assessment Program (LEAP). Requires standards-based assessments for required subjects
(English language arts, math, science, and social studies) to be implemented by the State
Board of Elementary and Secondary Education (BESE) and administered in at least grades
3 through 11. Provides that such assessments be based on state content standards and
rigorous student achievement standards comparable to national student achievement levels. 
Proposed law retains present law.
Proposed law requires the governing authority of each public high school to ensure that a
student who graduates from high school after completing a college preparatory curriculum
has the basic knowledge and skills needed to undertake entry-level postsecondary
coursework as demonstrated by the student meeting the college readiness benchmarks
established by ACT for English and mathematics.
Proposed law provides that a public postsecondary institution may seek and receive
reimbursement from the governing authority of a high school for remedial or developmental
coursework provided to a high school graduate who fails to meet the established college
readiness benchmarks and who is required to take remedial or developmental coursework
as a condition of admission or enrollment at a Louisiana public postsecondary education
institution.

Effective upon signature of the governor or lapse of time for gubernatorial action.

Summary of Amendments Adopted by Senate
Committee Amendments Proposed by Senate Committee on Education to the

1. Requires a high school governing authority to ensure students completing a
college preparatory curriculum are college ready. 
2. Allows public postsecondary institutions to seek and receive reimbursement
from the governing authority of a high school whose graduates fail to meet
college readiness benchmarks and who are required to take remedial or
developmental coursework.
3. Prohibits the reimbursement from exceeding published tuition amounts.
4. Provides that reimbursement shall not be provided more than once for the
same level of coursework.
5. Limits reimbursement to no more than two remedial or developmental
courses per student.
6. Prohibits a postsecondary institution from receiving reimbursement from
both the student and a high school governing authority.
7. Provides that reimbursement is provided only if the student takes the
remedial or developmental courses in the first academic year immediately
following high school graduation.
