ENROLLED ACT No. 448 2018 Regular Session HOUSE BILL NO. 116 BY REPRESENTATIVE ZERINGUE 1 AN ACT 2 To amend and reenact R.S. 49:214.6.2(A) and to enact R.S. 49:191(11)(a), relative to the 3 Coastal Protection and Restoration Authority; to authorize the Coastal Protection and 4 Restoration Authority to issue rules, regulations, or guidelines for the 5 implementation of their existing contracting authority; and to provide for related 6 matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 49:214.6.2(A) is hereby amended and reenacted and R.S. 9 49:191(11)(a) is hereby enacted to read as follows: 10 §191. Termination of legislative authority for existence of statutory entities; phase- 11 out period for statutory entities; table of dates 12 Notwithstanding any termination dates set by any previous Act of the 13 legislature, the statutory entities set forth in this Section shall begin to terminate their 14 operations on July first of each of the following years, and all legislative authority 15 for the existence of any statutory entity, as defined in R.S. 49:190, shall cease as of 16 July first of the following year, which shall be the termination date: 17 * * * 18 (11) July 1, 2023: 19 (a) The Coastal Protection and Restoration Authority and the Coastal 20 Restoration and Protection Authority Board to be reviewed by and re-creation to be 21 considered by the House Committee on Natural Resources and Environment and the 22 Senate Committee on Natural Resources. HB NO. 116 ENROLLED 1 shall be reviewed and re-created every six years to coincide with the review and 2 adoption of the comprehensive master plan for integrated coastal restoration. 3 * * * 4 §214.6.2. Functions and responsibilities; coastal activities 5 A. The authority shall administer the programs of the Coastal Protection and 6 Restoration Authority Board. The executive director may use his contracting 7 authority, or the contracting authority of any state department or agency, to 8 implement the provisions of this Chapter. Such His contracting authority shall 9 include construction management at risk, operation and maintenance, design-build, 10 design-build-operate and maintain, design-build-finance-operate and maintain, 11 outcome-based performance contracts, or any combination of design, construction, 12 finance, and services for operation and maintenance of an integrated coastal 13 protection project, where appropriate. The Coastal Protection and Restoration 14 Authority shall promulgate, through the Administrative Procedure Act, rules, 15 regulations, or guidelines for the implementation of the contracting authority granted 16 by the provisions of this Section.
