HLS 18RS-265 ORIGINAL 2018 Regular Session HOUSE BILL NO. 149 BY REPRESENTATIVE HOFFMANN HEALTH CARE/PROVIDERS: Provides for dissemination by certain healthcare providers of information to patients concerning bone marrow donation 1 AN ACT 2To amend and reenact R.S. 40:1263.3(5)(a)(introductory paragraph) and to enact Part VII-B 3 of Chapter 20 of Title 37 of the Louisiana Revised Statutes of 1950, to be comprised 4 of R.S. 37:1745.21, and R.S. 40:1263.3(5)(a)(iv) through (vi) and (6), relative to 5 bone marrow donations; to provide for the dissemination of bone marrow donor 6 information; to provide for duties of the Louisiana State Board of Medical Examiners 7 and the Louisiana State Board of Nursing in disseminating information; to provide 8 for the duties of the secretary for the Louisiana Department of Health; and to provide 9 for related matters. 10Be it enacted by the Legislature of Louisiana: 11 Section 1. Part VII-B of Chapter 20 of Title 37 of the Louisiana Revised Statutes of 121950, comprised of R.S. 37:1745.21, is hereby enacted to read as follows: 13 PART VII-B. HEALTHCARE PROVIDERS–BONE MARROW DONATIONS 14 §1745.21. Bone marrow donor awareness 15 A. The Louisiana State Board of Medical Examiners and the Louisiana State 16 Board of Nursing shall provide the following information concerning bone marrow 17 donations to healthcare providers licensed by the boards for dissemination to 18 patients: 19 (1) The need for bone marrow donations. 20 (2) Patient populations that would benefit from bone marrow donations. The Louisiana State Board of Medical Examiners and the Louisiana State 5 Board of Nursing may each exercise discretion in determining which healthcare 6 providers shall be responsible for disseminating the information provided for in 7 Subsection A of this Section to patients. 8 C. The Louisiana State Board of Medical Examiners and the Louisiana State 9 Board of Nursing may promulgate rules and regulations in accordance with the 10 Administrative Procedure Act in order to carry out the provisions of this Chapter. 11 Section 2. R.S. 40:1263.3(5)(a)(introductory paragraph) is hereby amended and 12reenacted and R.S. 40:1263.3(5)(a)(iv) through (vi) and (6) are hereby enacted to read as 13follows: 14 §1263.3. Powers and duties 15 The secretary shall: 16 * * * 17 (5)(a) Educate residents of the state about all of the following: 18 * * * 19 (iv) Patient populations that would benefit from bone marrow donations. 20 (v) How to join the national bone marrow registry. 21 (vi) How to acquire a free buccal swab kit from the national bone marrow registry. 22 * * * 23 (6) Cause information required by Subparagraph (5)(a) of this Section to be 24published on the Louisiana Department of Health website for the purpose of enhancing 25public awareness of bone marrow donations. Department of Health to publish information on bone marrow donations on the department's website. Proposed law provides for the La. State Board of Medical Examiners (LSBME) and the La. State Board of Nursing (LSBN) to provide information concerning bone marrow donations to healthcare providers licensed by the boards. Proposed law provides for those healthcare providers licensed by the boards to make this information available to patients. Proposed law provides that the following information shall be given to the patients by the healthcare providers: (1) The need for bone marrow donations. (2) Patient populations that would benefit from bone marrow donations. (3) How to join the national bone marrow registry. (4) How to acquire a free buccal swab kit from the national bone marrow registry. Proposed law provides that the LSBME and the LSBN may exercise discretion in determining which healthcare providers will be responsible for providing patients with this information. Proposed law provides that the LSBME and the LSBN may promulgate rules to carry out duties provided for in proposed law. Proposed law requires the secretary for the La. Department of Health to publish on the department's website information concerning bone marrow donations.
