HOUSE BILL NO. 198

1	AN ACT
2 To amend and reenact R.S. 46:2631 and 2635(A), relative to the Traumatic Head and Spinal
3 Cord Injury Trust Fund; to provide for the purposes of the fund; to provide for the
4 distribution of funding; to ensure that the fund is used as a funding source of last
5 resort; to specify that Medicare and Medicaid sources shall be expended before using
6 monies in the fund; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 46:2631 and 2635(A) are hereby amended and reenacted to read as
9 follows: 
10 §2631.  Purpose
11	The purpose of this Chapter is to provide for the development of a
12 rehabilitation program for persons disabled by traumatic head and spinal cord
13 injuries through the establishment of a trust fund in the state treasury to be funded
14 by additional fees imposed on motor vehicle violations in this state for the offenses
15 of driving under the influence, reckless operation, and speeding.  The purpose of the
16 Traumatic Head and Spinal Cord Injury Trust Fund is to provide Louisiana citizens
17 who survive traumatic head or spinal cord injuries a source of funds for services
18 enabling them with assistance to return to a reasonable level of functioning and
19 independent living in their communities.

1 §2635.  Expenditures
2	A.  Except as provided in R.S. 46:2633(D)(2), money in the trust fund shall
3 be distributed for the sole purpose of funding the cost of care or supportive services
4 for traumatic head and spinal cord injury, including the administrative costs
5 attributable to services provided by the trust fund program.  The fund shall be
6 considered as a source of last resort after private and governmental Medicare and
7 Medicaid sources have been expended for Louisiana citizens.

9 Section  2.  This Act shall become effective upon signature by the governor or, if not
10 signed by the governor, upon expiration of the time for bills to become law without signature
11 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
12 vetoed by the governor and subsequently approved by the legislature, this Act shall become
13 effective on the day following such approval.
