FEES/LICENSES/PERMITS: Increases individual sewage fees imposed by the office of
public health
1 AN ACT
2To amend and reenact R.S. 40:31.32(B) and (E)(2), relative to individual sewage fees; to
3 provide for an increase in an individual sewage fee; to provide for effectiveness; and
4 to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 40:31.32(B) and (E)(2) are hereby amended and reenacted to read
7as follows:
8 ยง31.32. Individual sewage fees

10 B. The department shall charge and collect a one-time fee of one hundred
11 fifty dollars for each individual-type sewerage system installed for residential use.
12 Such fee shall be payable by the manufacturer or, if authorized by the department,
13 manufacturer-authorized system distributor, franchise, sale, franchisee, seller, or
14 agent thereof.

1 (2) The provisions of Paragraph (E)(1) of this Section (1) of this Subsection
2 shall not be effective unless the department complies with the provisions of R.S.
3 40:1154. R.S. 40:1281.23.

5 Section 2. This Act shall become effective upon signature by the governor or, if not
6signed by the governor, upon expiration of the time for bills to become law without signature
7by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
8vetoed by the governor and subsequently approved by the legislature, this Act shall become
9effective on the day following such approval.

Abstract: Increases the amount of an individual sewage fee imposed by the office of public
health.
Present law provides that the department shall charge and collect a one-time fee of $100 for
each individual-type sewerage system installed for residential use.
Proposed law increases the fee from $100 to $150.
Proposed law corrects the terms "franchise" and "sale" to "franchisee" and "seller" to fit with
the meaning of present law.
Proposed law makes technical changes and corrects a citation.
Effective upon signature of governor or lapse of time for gubernatorial action.
