ENROLLED ACT No. 551 2018 Regular Session HOUSE BILL NO. 441 BY REPRESENTATIVES STOKES, ABRAMSON, AMEDEE, BARRAS, BERTHELOT, BILLIOT, BOUIE, BRASS, TERRY BROWN, CARMODY, ROBBY CARTER, CHANEY, COX, DAVIS, GISCLAIR, GLOVER, HAZEL, HOFFMANN, JACKSON, JEFFERSON, JENKINS, JONES, LEBAS, LEGER, LYONS, MAGEE, MARCELLE, MIGUEZ, PIERRE, REYNOLDS, SCHEXNAYDER, SMITH, STAGNI, THOMAS, WRIGHT, AND ZERINGUE AND SENATOR THOMPSON 1 AN ACT 2 To enact R.S. 47:463.47.1, relative to motor vehicle special prestige license plates; to 3 provide for the "Military Order of the Purple Heart First Responder Program" special 4 prestige license plate; to provide for the creation, issuance, design, fees, distribution, 5 and rule promulgation applicable to such license plates; and to provide for related 6 matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 47:463.47.1 is hereby enacted to read as follows: 9 ยง463.47.1. Special prestige license plate; "Military Order of the Purple Heart First 10 Responder Program" 11 A. The provisions of the Section shall be applicable to "Military Order of the 12 Purple Heart First Responder" recipients. 13 B. Notwithstanding the provisions of R.S. 47:463(A)(3)(b), the secretary of 14 the Department of Public Safety and Corrections shall establish a special prestige 15 license plate to be used in lieu of a regular motor vehicle registration license plate 16 on passenger cars, pickup trucks, recreational vehicles, motorcycles, and vans, which 17 may be issued upon application to any recipient of the "Military Order of the Purple 18 Heart First Responder" award. The "Military Order of the Purple Heart First 19 Responder Program" special prestige plate shall bear a likeness of the award centered 20 on the left side of the license plate. The fee for the license plate shall be the standard motor vehicle license 2 tax imposed by Article VII, Section 5 of the Constitution of Louisiana, and a 3 handling fee of three dollars and fifty cents for each plate to be retained by the 4 department to offset a portion of administrative costs. 5 D. The secretary shall promulgate rules and regulations necessary to 6 implement the provisions of this Section, including but not limited to rules governing 7 the transfer of the license plates from one vehicle to another. 8 E. Except as otherwise provided for in this Subsection, each special prestige 9 license plate issued pursuant to this Section shall be returned to the secretary upon 10 the death of the person to whom the plate was issued. A surviving spouse of a 11 person to whom a license plate was issued pursuant to this Section may retain a 12 license plate issued pursuant to this Section, provided the surviving spouse has not 13 remarried and provided the surviving spouse applies to the secretary for a transfer 14 of the license plate to the surviving spouse. A special prestige license plate 15 transferred pursuant to this Subsection to a surviving spouse shall be returned to the 16 secretary upon death or remarriage of the surviving spouse.
