HOUSE BILL NO. 481
BY REPRESENTATIVE CARPENTER
PARKS/RECREATION COMMN:  Provides relative to the Recreation and Park
Commission for the Parish of East Baton Rouge
1	AN ACT
2To enact R.S. 33:4570.5, relative to the Recreation and Park Commission for the Parish of
3 East Baton Rouge; to provide relative to the powers and duties of the commission;
4 to place limitations on the commission's authority to acquire, lease, develop, operate,
5 and manage certain properties and facilities; and to provide for related matters.
6	Notice of intention to introduce this Act has been published
7	as provided by Article III, Section 13 of the Constitution of
8	Louisiana.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 33:4570.5 is hereby enacted to read as follows:
11 ยง4570.5.  Properties and facilities; wild animals; location
12	Notwithstanding any other provision of law to the contrary, the commission
13 shall not acquire, lease, construct, develop, operate, or manage any property or
14 facility for the purpose of maintaining a collection of wild animals for study,
15 conservation, or display to the public, unless any such property or facility is located
16 within the following boundary: beginning at the intersection of Thomas Road and
17 Plank Road, then north on Plank Road to its intersection with Lavey Lane, then west
18 on Lavey Lane to its intersection with Highway 19, then south on Highway 19 to its
19 intersection with Thomas Road, then east on Thomas Road to the point of beginning.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Abstract:  Relative to the Recreation and Park Commission for the Parish of East Baton
Rouge, limits the authority of the commission to acquire, lease, develop, operate, and
manage certain properties.
Present law creates the Recreation and Park Commission for the Parish of East Baton Rouge,
as a political subdivision of the state whose jurisdiction extends throughout the whole parish.
Provides that the commission is governed by a nine-member board of commissioners.
Provides relative to the powers and duties of the commission including, but not limited to,
the following:
(1)To incur debts and contract obligations.
(2)To sue and be sued.
(3)To acquire by purchase, donation, expropriation, and otherwise, from other political
entities or from any other source, money and property, movable and immovable,
tangible and intangible.
(4)To own, administer, alienate, and otherwise dispose of its money and property.
(5)To impose and collect a property tax not to exceed 18 mills on the dollar of assessed
value for the purpose of acquiring, developing, maintaining, and operating the public
parks and recreational properties and facilities of the commission and in making
available funds for the operating budget.
Proposed law retains present law but prohibits the commission from acquiring, leasing,
developing, operating, or managing any property or facility for the purpose of maintaining
a collection of wild animals for study, conservation, or display to the public unless the
property or facility is located in a certain location.
Effective upon signature of governor or lapse of time for gubernatorial action.
