HOUSE BILL NO. 535
BY REPRESENTATIVE SMITH
BOARDS/COMMISSIONS:  Provides for changes relative to the Louisiana Commission on
HIV, AIDS, and Hepatitis C
1	AN ACT
2To amend and reenact R.S. 40:2018.1, relative to the Louisiana Commission on HIV, AIDS,
3 and Hepatitis C; to change the composition and membership of the commission; to 
4 provide for an extension of the termination date;  and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 40:2018.1 is hereby amended and reenacted to read as follows: 
7 ยง2018.1.  Louisiana Commission on HIV,/AIDS, and Hepatitis C Education,
8	Prevention, and Treatment
9	A.  There shall be established within the office of the governor Louisiana
10 Department of Health, office of public health, a commission which shall be
11 designated the "Louisiana Commission on HIV,/AIDS Education, Prevention, and
12 Treatment, and Hepatitis C", composed of thirty-six twenty-seven members, as
13 provided in Subsection B of this Section.
14	B.(1)  Twenty-three Eighteen members shall serve at the governor's pleasure
15 and shall be appointed by the governor as follows:
16	(a)  (I)  Two Four persons infected living with the human immunodeficiency
17 virus (HIV), at least one two of whom represents represent a racial or ethnic
18 subpopulation.
19	(ii)  Two persons infected with hepatitis C, where one person is co-infected
20 with HIV, and at least one of whom represents a racial or ethnic subpopulation.

1	(b)(i)  Two One representatives representative from a community-based
2 provider organizations organization providing services to persons infected living
3 with the human immunodeficiency virus, one of which represents a racial or ethnic
4 subpopulation.
5	(ii)  Two One medically qualified representatives representative from a
6 medical provider or community-based provider organizations organization providing
7 services to persons infected living with hepatitis C or HIV, one of which represents
8 a racial or ethnic subpopulation.
9	(c)  One representative from the Louisiana Primary Care Association.
10	(d)  Two One representatives representative from the statewide HIV
11 Community Planning Group.
12	(e)  One nurse representative from the Louisiana Nursing Association, who
13 serves patients with HIV or hepatitis C.
14	(f)  One social worker representative from the Louisiana Chapter of the
15 National Association of Social Workers.
16	(g)  Five Four Ryan White HIV/AIDS Treatment Modernization Act 
17 grantees consisting of one Part A grantee, one Part B grantee, one Part C grantee, and
18 one Part D grantee, and one representative of the Delta Region AIDS and Education
19 Training Center.
20	(h)  One representative from the Louisiana Psychological Association.
21	(h)  (i) One Two representative representatives from the Louisiana
22 Interchurch Conference faith-based community.
23	(j)  One representative from a dental provider serving patients with HIV or
24 hepatitis C.
25	(i)  (k)The president of the Louisiana State Medical Society or his designee.
26	(j)  (l)The president of the Louisiana Hospital Association or his designee.
27	(2)  Eleven Seven members shall be appointed by the governor by virtue of
28 their position as follows:
29	(a)  The state superintendent of education or his designee.

1	(b)  The secretary of the Department of Public Safety and Corrections or his
2 designee.
3	(c)  Four Two representatives from the Louisiana Department of Health, who
4 have knowledge of policies related to HIV, and AIDS, and hepatitis C, and who work
5 in the office of public health, office of behavioral health, and the office of health
6 services financing, respectively.
7	(d)  The commissioner of the Department of Insurance or his designee.
8	(e)  The deans of the Louisiana State University School of Medicine, New
9 Orleans and Shreveport, or their designees who have an affiliation with the
10 Infectious Disease Department One dean of a Louisiana medical school, or his
11 designee.
12	(f)  The dean of the Tulane University School of Medicine or his designee
13 who has an affiliation with the Infectious Disease Department.
14	(f)  (g)The dean of one of the Colleges of Pharmacy in Louisiana or his
15 designee who has an affiliation with the HIV/AIDS or hepatitis C practice.
16	(3)  Two members shall be appointed as follows:
17	(a)  One member of the Senate appointed by the president of the Senate.
18	(b)  One member of the House of Representatives appointed by the speaker
19 of the House of Representatives.
20	(4)  The governor shall strive for diversity in geography, race, sex, and
21 educational background in appointing members to the commission.  Each member
22 appointed by the governor shall serve at his pleasure and shall be subject to Senate
23 confirmation.  The legislative members shall serve at the pleasure of the presiding
24 officer of the respective legislative body.
25	C.  The chairman of the commission shall be elected annually by the
26 commission members appointed by the governor and shall serve as chairman without
27 salary.  The chairman shall report directly to the governor.
28	D.  The commission shall hold at least four six regular meetings each year at
29 a place designated by the chairman.  At least two of these regular meetings shall be

1 for the purpose of reviewing reports of the Ryan White Regional Consortia.  The
2 commission members shall be compensated for travel in connection with
3 commission meetings and official commission business as approved by the chairman
4 of the commission.  Reimbursement for travel expenses shall be in accordance with
5 the travel regulations of the division of administration.  All meetings of the
6 commission shall be convened in the state of Louisiana.
7	E.  The functions of the commission shall be to:
8	(1)  Serve as an advisory body to the governor and the Louisiana Department
9 of Health on hepatitis C and HIV and AIDS related matters.
10	(2)  Serve as a coordinating forum on hepatitis C and HIV and AIDS related
11 matters between and among state agencies, local government, and other
12 nongovernmental groups.
13	(3)  Research and review all state regulations, guidelines, policies, and
14 procedures relative to prevention and treatment and care of hepatitis C, HIV
15 infection, and AIDS and, when appropriate, make recommendations to the governor,
16 the secretary of the Louisiana Department of Health, and the legislature.
17	(4)  Provide a forum for an annual public hearing on hepatitis C and HIV and
18 AIDS related matters as well as a mechanism for other public comment comments
19 and peer review reviews on federal and state-funded programs related to hepatitis C,
20 HIV, and AIDS.
21	F.  The commission may request administrative and technical support from
22 the Louisiana Department of Health, office of the secretary, HIV program office, and
23 the office of public health to carry out the commission's functions and
24 responsibilities under this Section.
25	G.  The commission shall terminate on September 1, 20172022.

Abstract:  Changes the composition of the La. Commission on HIV, AIDS, and Hepatitis C.
Present law establishes the "La. Commission on HIV, AIDS, and Hepatitis C" and provides
for the membership of the commission.
Proposed law changes the commission's name to the "La. Commission on HIV/AIDS
Education, Prevention, and Treatment".
Proposed law changes the composition of the board to decrease the amount of members from
36 to 27, as follows:
(1) 18 members shall serve at the governor's pleasure and shall be appointed by the
governor as follows:
(a)  Four persons living with the human immunodeficiency virus (HIV), at least two
of whom represent a racial or ethnic subpopulation.
(b)  One representative from a community-based provider organization providing
services to persons living with HIV which represents a racial or ethnic
subpopulation.
(c)  One medically qualified representative from a medical provider or
communitybased provider organization providing services to persons living with
HIV which represents a racial or ethnic subpopulation.
(d)  One representative from the La. Primary Care Association.
(e)  One representative from the statewide HIV Community Planning Group.
(f)  A nurse representative from the La. Nursing Association, serving patients with
HIV.
(g)  A social worker representative from the La. Chapter of the National Association
of Social Workers.
(h)  4 Ryan White Treatment and Modernization Act grantees consisting of at least
one Part A grantee, one Part B grantee, one Part C grantee, one Part D grantee.
(i)  Two representatives from the La. faith-based community.
(j) The president of the La. State Medical Society or his designee.
(k)  The president of the La. Hospital Association or his designee.
(2)  Seven members shall be appointed by the governor by virtue of their position as
follows:
(a)  The state superintendent of education or his designee.

(b)  The secretary of the Dept. of Public Safety and Corrections or his designee.
(c)  Two representatives from the Dept. of Health, who have knowledge of policies
related to HIV and AIDS who work in the office of public health, office of
behavioral health, and the office of health services financing, respectively.
(d) The commissioner of the Dept. of Insurance or his designee.
(e)  One dean of a La. medical school or his designee.
(f)  The dean of one of the Colleges of Pharmacy in La. or his designee who has an
affiliation with the HIV/AIDS practice.
(3)  Two members shall be appointed as follows:
(a)  A member of the Senate appointed by the president of the Senate. 
(b)  A member of the House of Representatives appointed by the speaker of the
House of Representatives.
Proposed law changes the termination date of present law from Sept. 1, 2017 to
Sept. 1, 2022.
