HOUSE BILL NO. 652

PROCUREMENT:  Requires governmental entities that receive state funding to select
Louisiana companies
1	AN ACT
2To enact R.S. 39:1733.1, relative to procurement of services; to require governmental
3 entities that receive state funds to contract with Louisiana companies; and to provide
4 for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 39:1733.1 is hereby enacted to read as follows:
7 ยง1733.1.  Preference for Louisiana businesses
8	A.  Notwithstanding any provision of law to the contrary, if any agency of the
9 state or any political subdivision of the state that receives state funds desires to enter
10 a contract for services, it shall, to the greatest degree feasible, contract with a
11 Louisiana company for such services.
12	B.  For purposes of this Section, a "Louisiana company" is one that operates
13 primarily in Louisiana or performs substantially all of its work in Louisiana, or is
14 headquartered in Louisiana with a substantial portion of its assets located in
15 Louisiana and which is involved in commerce for the purpose of providing services,
16 and at least eighty percent of the total employees of such business are domiciled in
17 the state of Louisiana and that at least eighty percent of the payroll of the business
18 is paid to such employees.

Proposed law requires any agency of the state or any political subdivision of the state that
receives state funds to contract for services with a La. company to the greatest degree
feasible.  Provides that an La. company is one that operates primarily in La. or performs
substantially all of its work in La., or is headquartered in La. with a substantial portion of
its assets located in La. and which is involved in commerce for the purpose of providing
services, and at least 80% of the total employees of such business are domiciled in the state
of Louisiana and that at least 80% of the payroll of the business is paid to such employees.
