ENROLLED ACT No. 714 2018 Regular Session HOUSE BILL NO. 669 BY REPRESENTATIVE MARCELLE 1 AN ACT 2 To amend and reenact R.S. 32:57.1(A), relative to the status of an operator's license after 3 failing to appear in court; to provide discretion for a magistrate or judge to issue a 4 suspension on the renewal of an operator's license; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 32:57.1(A) is hereby amended and reenacted to read as follows: 7 ยง57.1. Failure to honor written promise to appear; penalty; disposition of fines 8 A. Whenever an arrested person who was released on his written promise to 9 appear before a magistrate at the place and time specified in a summons described 10 in R.S. 32:391(B) fails to honor his written promise to appear, the magistrate or 11 judge of the court exercising jurisdiction shall may immediately forward to the 12 Department of Public Safety and Corrections notice of the failure to appear, with 13 information necessary for identification of the arrested person. Thereupon, unless the 14 original charges have been disposed of, the Department of Public Safety and 15 Corrections shall immediately notify the arrested person of suspension of his 16 operator's license and the imposition of a fifty-dollar fee, regardless of the 17 disposition of the original charge. The Department of Public Safety and Corrections 18 likewise shall inform the arrested person that his operator's license cannot be 19 renewed or reissued until the forwarding court exercising jurisdiction certifies that Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions.
