HLS 18RS-1104 ORIGINAL 2018 Regular Session HOUSE BILL NO. 728 BY REPRESENTATIVE LEGER HEALTH/BEHAVIORAL: Provides relative to standards for Medicaid-funded substance use disorder treatment 1 AN ACT 2To enact Subpart E of Part XIII of Chapter 3 of Title 46 of the Louisiana Revised Statutes 3 of 1950, to be comprised of R.S. 46:460.101 through 460.103, relative to Medicaid- 4 funded substance use disorder treatment; to provide relative to substance use disorder 5 treatment furnished through the Medicaid managed care program; to provide for 6 substance use disorder treatment standards; to establish requirements for contracts 7 between the Louisiana Department of Health and Medicaid managed care 8 organizations; to provide for administrative rulemaking; and to provide for related 9 matters. 10Be it enacted by the Legislature of Louisiana: 11 Section 1. Subpart E of Part XIII of Chapter 3 of Title 46 of the Louisiana Revised 12Statutes of 1950, comprised of R.S. 46:460.101 through 460.103, is hereby enacted to read 13as follows: 14 SUBPART E. SUBSTANCE USE DISORDER TREATMENT 15 §460.101. Findings and purpose 16 A. The 2016 Surgeon General's Report on Alcohol, Drugs, and Health 17 indicates that patients who undergo residential treatment for substance use disorders 18 for a duration of fewer than ninety days are significantly less likely to show 19 improved outcomes and more likely to relapse. HLS 18RS-1104 ORIGINAL HB NO. 728 1 substance use disorders often represent both an inadequate level of care and a 2 wasteful allocation of limited healthcare resources. 3 B. The purpose of this Subpart is to provide for the appropriate level and 4 manner of substance use disorder treatment through the major publicly funded 5 healthcare program of this state, and thereby better address the critical public health 6 problem that these disorders pose. 7 §460.102. Substance use disorder treatment; standards; Medicaid managed care 8 organization contracts 9 A. The department shall establish standards for substance use disorder 10 treatment in the Medicaid managed care program of this state that are consistent with 11 evidence-based best practices. Such standards shall include, without limitation, 12 minimum length of stay criteria for residential treatment. 13 B. In developing its contractual agreements with each managed care 14 organization that contracts with this state to provide Medicaid benefits and services 15 to Medicaid enrollees, the department shall ensure that each such agreement reflects 16 the substance use disorder treatment standards required by the provisions of this 17 Section. 18 §460.103. Administrative rulemaking 19 The secretary of the department shall promulgate all rules and regulations in 20 accordance with the Administrative Procedure Act as are necessary to implement the 21 provisions of this Subpart.
