ENROLLED ACT No. 441 2018 Regular Session HOUSE BILL NO. 767 BY REPRESENTATIVE GISCLAIR 1 AN ACT 2 To amend and reenact R.S. 32:388(B)(1)(b)(iv), relative to trucks hauling concrete or 3 construction aggregates; to extend the termination date for two years for the 4 authorization of ready-mixed concrete trucks to exceed the maximum gross vehicle 5 weight under certain conditions; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 32:388(B)(1)(b)(iv) is hereby amended and reenacted to read as 8 follows: 9 ยง388. Penalties; payments 10 * * * 11 B.(1) 12 * * * 13 (b) 14 * * * 15 (iv) Effective from August 1, 2012, through July 31, 2018 2020, no truck 16 hauling ready-mixed concrete shall be assessed a penalty for exceeding its maximum 17 permissible gross weight, as determined by law, provided the total excess weight is 18 ten percent or less of such truck's maximum permissible gross weight, such truck 19 contains a certificate evidencing its most recent mixer chip-out of build-up occurred 20 within the previous ninety days, such truck does not exceed the posted load while 21 crossing a posted bridge, such truck is not operating on the interstate system, and no 22 tire on such truck exceeds its tire weight rating. HB NO. 767 ENROLLED 1 by law, such truck shall be assessed a penalty calculated on the total amount by 2 which the truck's weight exceeds its maximum permissible gross weight, as 3 determined by law.
