ENROLLED ACT No. 589 2018 Regular Session HOUSE BILL NO. 820 BY REPRESENTATIVE JACKSON 1 AN ACT 2 To amend and reenact R.S. 22:995(A)(1) and R.S. 37:2801(3)(a), relative to the practice of 3 chiropractic; to provide for the definition of the practice of chiropractic; to provide 4 for reimbursement for chiropractic services; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 22:995(A)(1) is hereby amended and reenacted to read as follows: 7 §995. Selection of type of treatment; reimbursement 8 A.(1) Notwithstanding any provision of any policy or contract of insurance 9 or health benefits issued after the effective date of this Section, whenever such policy 10 or contract provides for payment or reimbursement for any service, and such service 11 may be legally performed by a chiropractor licensed in this state, such payment or 12 reimbursement under such policy or contract shall not be denied the chiropractor 13 when such service is rendered by a person so licensed. Terminology in such policy 14 or contract deemed discriminatory against any such person or method of practice, 15 including but not limited to the manner of payment or reimbursement under the 16 policy, shall be null and void. The provisions of this Paragraph shall not affect any 17 provision of the policy or contract regarding payment for services provided by a non- 18 contracted provider. 19 * * * 20 Section 2. R.S. 37:2801(3)(a) is hereby amended and reenacted to read as follows: 21 §2801. HB NO. 820 ENROLLED 1 in, the diagnosing of conditions associated with the functional integrity of the spine 2 and treating by adjustment, manipulation, and the use of the physical and other 3 properties of heat, light, water, electricity, sound, massage, therapeutic exercise, 4 mobilization, mechanical devices such as mechanical traction and mechanical 5 massage, and other physical rehabilitation measures for the purpose of correcting 6 interference with normal nerve transmission and expression. A chiropractor may 7 also make recommendations relative to personal hygiene and proper nutritional 8 practices for the rehabilitation of the patient.
