HLS 18RS-2038 ORIGINAL 2018 Regular Session HOUSE BILL NO. 822 BY REPRESENTATIVE HENSGENS HEALTH CARE/FACILITIES: Provides relative to the moratorium on licensure of level 4 adult residential care providers 1 AN ACT 2To amend and reenact R.S. 40:2166.7.1 and to repeal Section 2 of Act No. 417 of the 2017 3 Regular Session of the Legislature of Louisiana, relative to licensure of level 4 adult 4 residential care providers; to extend the termination date of a moratorium on 5 licensure of such providers; to repeal conditions of effectiveness of certain laws 6 relative to the moratorium; and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 40:2166.7.1 is hereby amended and reenacted to read as follows: 9 §2166.7.1. Moratorium on licensure of level 4 adult residential care providers 10 Notwithstanding any other provision of law to the contrary, the department 11 shall implement a moratorium on the licensure of additional level 4 adult residential 12 care providers until July 1, 2017 2023. The moratorium shall not apply to a provider 13 which has received facility need review approval from the department for a level 4 14 adult residential care provider on or before April 25, 2012. 15 Section 2. Section 2 of Act No. 417 of the 2017 Regular Session of the Legislature 16of Louisiana is hereby repealed in its entirety. Present law establishes a moratorium on licensure of new level 4 adult residential care providers, known commonly as "assisted living facilities", until July 1, 2017. Proposed law extends the moratorium until July 1, 2023. Present law (Act No. 417 of the 2017 R.S., Section 2) provides that an extension of the moratorium until July 1, 2018 will become effective in the event a specific appropriation by the legislature is made for such purposes and the program receives approval by the Centers for Medicare and Medicaid Services.
