HLS 18RS-3693 ORIGINAL 2018 Regular Session HOUSE CONCURRENT RESOL UTION NO. 99 BY REPRESENTATIVE AMEDEE ECONOMIC DEVELOPMENT: Requests the Department of Economic Development to study and report on commercial activities by state-owned companies or organizations based in and subsidized by certain foreign governments and requests the state treasurer to certify that no public funds are used to support commercial activities in certain foreign governments 1 A CONCURRENT RESOL UTION 2To urge and request the Department of Economic Development to study predatory 3 investments and other unfair trade practices in Louisiana by state-owned companies 4 or organizations based in and subsidized by communist countries and submit a report 5 of its findings, to urge and request the state treasurer to certify that no state funds 6 have been used to support state-owned companies or organizations based in 7 communist countries and submit a report verifying that the certification was 8 performed and including any findings he deems relevant, and to request that both 9 reports be submitted to the Legislature of Louisiana not later than sixty days prior 10 to the convening of the 2019 Regular Session of the Legislature of Louisiana. 11 WHEREAS, private ownership of capital, free movement of labor, and respect for 12fundamental human rights are foundations upon which the American economy and the 13economy of Louisiana are based; and 14 WHEREAS, many of the laws and institutions developed since World War II do not 15adequately protect against the threats posed to the global economy, the economy of the 16United States, and the economy of Louisiana by the forms of "state capitalism" practiced by 17the People's Republic of China and other communist countries; and 18 WHEREAS, predatory investments, the theft of intellectual property, and unfair trade 19practices committed by companies and organizations that are subsidized by the governments Page 1 of 3 HLS 18RS-3693 ORIGINAL HCR NO. 99 1of China and other communist countries cause or threaten to cause harm to companies and 2industries in the United States and the state of Louisiana including but not limited to the 3state's shellfish and chemical industries; and 4 WHEREAS, the government of the state of Louisiana provides public funds to 5encourage investment by companies and organizations in Louisiana, and such investments 6affect Louisiana's existing industries, its workers, and its economic system of free enterprise. 7 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 8urge and request the Department of Economic Development to study investments and other 9commercial activities by state-owned companies or organizations based in and subsidized 10by a communist country that are doing business in Louisiana, particularly as they relate to 11the impact such investments and commercial activities have on existing industries, worker 12safety, employment, the protection of intellectual property, and competition in the state of 13Louisiana. 14 BE IT FURTHER RESOLVED that the Department of Economic Development shall 15submit a written report of its findings to the Louisiana Legislature by not later than sixty 16days prior to the convening of the 2019 Regular Session of the Legislature. 17 BE IT FURTHER RESOLVED that the Legislature of Louisiana does hereby urge 18and request the state treasurer to certify that no public funds have been used whether through 19incentives, abatements, or any other means to support commercial activities, including 20investments, by companies or organizations that are owned in whole or in part by a foreign 21government that is identified as a communist government by the World Factbook of the 22United States Central Intelligence Agency. 23 BE IT FURTHER RESOLVED that the state treasurer shall submit a written report 24verifying that the requested certification was performed, along with any findings he deems 25relevant, to the Louisiana Legislature by not later than sixty days prior to the convening of 26the 2019 Regular Session of the Legislature. 27 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 28secretary of the Department of Economic Development and the state treasurer.
