(8/1/18) 1 AN ACT 2 To amend and reenact R.S. 32:1252(27) and to enact R.S. 32:1254(P), relative to marine 3 products; to provide certain definitions; to provide for a licensing exception for 4 certain manufacturers of marine products; to provide for certain terms and 5 conditions; and to provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 32:1252(27) is hereby amended and reenacted and R.S. 32:1254(P) 8 is hereby enacted to read as follows: 9 §1252. Definitions 10 The following words, terms, and phrases, when used in this Chapter, shall 11 have the meanings respectively ascribed to them in this Section, except where the 12 context clearly indicates a different meaning: 13 * * * 14 (27) "Marine product" means a new or used watercraft, boat, marine motor, 15 and a boat or watercraft trailer. The term also includes an outboard motor or a boat 16 with an inboard/outboard motor attached to it. Notwithstanding any other provision of law to the contrary, this 7 Chapter shall not apply to a watercraft designed for use primarily for 8 commercial or governmental purposes. Present law defines "marine product" as a new or used watercraft, boat, marine motor, and a boat or watercraft trailer. Present law excludes from the definition a new or used watercraft or boat adapted to be powered only by the occupant's energy. Proposed law excludes from the definition a watercraft designed for use primarily for commercial or governmental purposes. Proposed law provides that a watercraft designed for use primarily for commercial or governmental purposes shall not be subject to the regulations of the Motor Vehicle Commission. Effective August 1, 2018.
