(8/1/18) 1 AN ACT 2 To amend and reenact R.S. 32:1252(27), relative to marine products; to provide certain 3 definitions; to provide for a licensing exception for certain manufacturers of marine 4 products; to provide for certain terms and conditions; and to provide for related 5 matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 32:1252(27) is hereby amended and reenacted to read as follows: 8 ยง1252. Definitions 9 The following words, terms, and phrases, when used in this Chapter, shall 10 have the meanings respectively ascribed to them in this Section, except where the 11 context clearly indicates a different meaning: 12 * * * 13 (27) "Marine product" means a new or used watercraft, boat, marine motor, 14 and a boat or watercraft trailer. The term also includes an outboard motor or a boat 15 with an inboard/outboard motor attached to it. The term shall not mean a watercraft 16 designed for use primarily for commercial or governmental purposes or a new 17 or used watercraft or boat adapted to be powered only by the occupant's energy. DIGEST SB 104 Reengrossed 2018 Regular Session Allain Present law provides for the licensing and regulation of marine products. Present law defines "marine product" as a new or used watercraft, boat, marine motor, and a boat or watercraft trailer. Present law retains present law and excludes from the definition a new or used watercraft or boat adapted to be powered only by the occupant's energy. Proposed law excludes from the definition a watercraft designed for use primarily for commercial or governmental purposes. Effective August 1, 2018. (Amends R.S. 32:1252(27)) Summary of Amendments Adopted by Senate Committee Amendments Proposed by Senate Committee on Commerce, Consumer Protection, and International Affairs to the original bill 1. Excludes from the definition of marine products a watercraft designed for use primarily for commercial or governmental purposes and provides that such watercraft shall not be subject to the regulations of the Motor Vehicle Commission. Senate Floor Amendments to engrossed bill 1. Removes provision that a watercraft designed for use primarily for commercial or governmental purposes shall not be subject to the regulations of the Motor Vehicle Commission.
